NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 30, 2022, executed by Borrower(s), Rebekah Chuyka, to Larrick Law Offices, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5076, at Page 8049. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 208 Croft St, Beckley, WV 25801. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 19, 2023, of record in the Clerk’s Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

at 12:15 p.m.

PARCEL ONE: BEGINNING at the intersection of the south line of Croft Street with the east line of a 15 foot alley; thence with Croft Street S 76° 55’ E. 81.6 feet to the corner of property owned by George A. Watkins; thence with George A. Watkins S 13° 05` W. 94.6 feet; thence S 68° 03’ W 40.8 feet to a point on line of a 15-foot alley; thence with the line of said alley N 33° 50` W. 49.0 feet; thence N 06° 20’E. 85.5 feet to the point of beginning. PARCEL TWO: BEGINNING in the southern boundary line of Croft Street, a common corner of Lot No. 6 herein conveyed and Lot No. 7 of said subdivision; thence with the common line between the aforesaid Lot No. 7 and the said Lot No. 6 herein conveyed 105 feet to the northern right of way line of a 15-foot alley; thence with said right of way line of said alley in a western direction 57 feet to a stake, a common corner of the said Lot No. 6 herein conveyed and Lot No. 5 of said subdivision; thence with the common line between the lot herein conveyed and said Lot No. 5 128 feet to a stake in the aforesaid southern right of way line of Croft Street; thence with the aforesaid southern line of Croft Street in an eastern direction 50 feet to the point of beginning, containing 6,232.75 square feet, more or less; and being the same lot conveyed to Floyd M. Sayr by W.H. File, Special Commissioner, by deed dated the 16th day of October, 1929, and recorded in said Clerk’s Office in Deed Book No. 103, at Page 417. PARCEL THREE: BEGINNING at a stake a corner Lot No. 6 on North side of a 15 foot alley; thence with Lot No. 6, N. 16° 10’ E. 105 feet to a stake on South side of Croft Street; thence with same S. 73° 30’ E. 50 feet to a stake on the corner of a 15 foot alley; thence with said alley S. 5° 48’ W. 77 feet to a stake another 15 foot alley corner; thence with same S. 81 ° W. 70 feet to the BEGINNING, containing 5000 square feet (1/8 acre,) more or less. And being the same property acquired by Rebecca Chuyka, by deed dated the 27th day of June, 2022, from William Light and Mary Joe Nickerson, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to simultaneously herewith.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
