SUBSTITUTE TRUSTEES’
FORECLOSURE SALE
OF VALUABLE REAL ESTATE

Upon notification by First Community Bank, the holder of a Note secured by a Deed of Trust dated September 16, 2011, executed by Kevin L. Harvey, unto Gary R. Mills and Stephen M. Feola, as Trustees, recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Trust Deed Book 1218, at Page 184, of a default, and having been requested to institute these proceedings, and by virtue of the authority vested in us by a Substitution of Trustees, dated September 7, 2023, recorded in said Clerk’s Office in Resignation and Substitution of Trustee Book 1462, at Page 530, by which I was substituted as trustee for the said Gary R. Mills and Stephen M. Feola, I will
ON THE 22nd DAY OF FEBRUARY, 2024, AT 10:15 O’CLOCK A.M., at the front door of the Mercer County Courthouse at Princeton, West Virginia, offer for sale at public auction to the highest bidder, the following property, to-wit:
“All of that certain lot or parcel of land situate in the City of Princeton, Mercer County, West Virginia, known and designated as Lot No. 6, Section 1, City Section 135, of Park Avenue Land Association Addition to the city of Princeton, Mercer County, West Virginia, as shown on Microfilm Map No. 1795, and which said Lot is bounded and described as follows, to-wit:

“BEGINNING at a point formed by the Western line of Park Avenue and the Southern line of Reynolds Avenue, but which appears to be Second Street upon said map; thence with the said Western line of Park Avenue, S. 10° 29” E. 78 feet to a point formed by the intersection thereof and the Eastern terminus of the division line between Lots 6 and 7 of said Section; thence and with the said division line, S. 63 ° 32’ W. 137.7 feet to a point in the Eastern line of Lot No. 5 of said section; thence and with the Eastern line of said Lot No. 5, N. 26° 28’ W. 75 feet to a point in the Southern line of said Reynolds Avenue; thence and with the same, N. 63 ° 32’ E. 159 fee to the place of
BEGINNING.”

AND BEING the same property conveyed unto Kevin Lee Harvey and Sue Ellen Harvey by deed of Ordridge L. Thomas, Jr. and Pamela S. Thomas, husband and wife, dated February 3, 1993, filed for record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 730, at Page 481; the said Sue Ellen Harvey having conveyed all ofher right, title and interest in said property unto the said Kevin Lee Harvey by deed dated August 29, 2011, said deed to be recorded simultaneously herewith in said Clerk’s Office.
“The said parties of the first part hereby except, reserve and do not convey the following: “A small strip of land off of the Southern portion of the lot herein conveyed containing 200 square feet, more or less, which was conveyed to Rose Lee Gabbe widow, by J. L. Mann and Bertha S. Mann, his wife, by deed dated March 29, 1974, of record in said Clerk’s Office in Deed Book No. 507, at page 289, reference to which Deed is hereby made for a more specific description of the strip of land hereby reserved.
“This conveyance is subject to all pertinent restrictions, reservations and easements of record.”
The terms of the sale shall be cash in hand on the day of sale ( or such other arrangement as may be satisfactory to said Substitute Trustees and holder of the Note), and said property is being sold in “as is” condition. Said sale is subject to all taxes now due or to become due on said property, all liens, including but not limited to, sewer liens and restrictions, easements or other matters of record in said Clerk’s Office, affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate.
In the event there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale, or the period allowable for redemption under local law, whichever is longer.
Notice is also given that any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONbD PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
