NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 5, 2019, executed by Borrower(s), Sean D Barber, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of McDowell County, West Virginia, in Book 447, at Page 599. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 965 Magnolia Ave, Welch, WV 24801. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 13, 2023, of record in the Clerk’s Office in Book 457, Page 141. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of McDowell County, in Welch, West Virginia, on the following date:

15th day of February, 2024
at 1:00 p.m.

“all the following described real estate situate, lying and being in the Southwood Addition to the City of Welch, McDowell County, West Virginia,” and more particularly described as follows, to-wit: PARCEL. NO. 1: “Beginning at a point in the north line of Magnolia Avenue, said point being S. 62 42 E. 40 feet from a point where the west line of Camper`s Lane extended intersects with the north line of said Magnolia Avenue; thence leaving said Magnolia Avenue at right angles N. 27 18 E. 96.9 feet to a point in the south line of Edgewood Avenue; thence with said Edgewood Avenue, S. 62 42 E. 50 feet to a point; thence leaving said Edgewood Avenue at right angles S. 27 18 W. 95.1 feet to a point in the north line of Magnolia Avenue; thence with said Magnolia Avenue in a westerly direction with a line Parallel to and 4 ½ feet from the concrete curb for a distance of 50 feet, more or less, To the place of beginning, being a strip of land 50 feet in width and extending back between parallel lines from Magnolia Avenue to Edgewood Avenue.” PARCEL NO. 2: Lot No. 11 of the Southwood Addition to the City of Welch, McDowell County, W.Va, as shown and described on a map or plan entitled: `Revised Map of Part of Southwood Addition, Welch, West Virginia. Scale 1” = 50`, L.A. Osborne, City Engineer, May, 1938`, of record in the Office oi the Clerk of the County Commission of McDowell County, West Virginia, in Map Book 15, at Page 88, to which said map or plan reference is here had for a more particular description of the property hereby conveyed.” And being the same property conveyed to Sean D. Barber by Heath Beckner and Ashleigh Beckner, by Deed dated April 22, 2019, to be recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, simultaneously herewith. “This conveyance is made subject to any and all rights, reservations, covenants, conditions and restrictions heretofore granted or reserved by all predecessors in title to the property, the same as if set out herein in extenso except covenant, condition, or restriction indicating a preference.”

Being the same property conveyed to Sean D. Barber by the Deed dated May 23, 2019 and recorded in Deed Book 613 at Page 262 in the Office of the Clerk of the County Commission of McDowell County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
