NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated March 18, 2011, from Kalpeshkumar G. Patel to Gary R. Mills ans Stephen M. Feola, as trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1207, at page 695, the undersigned trustee will offer for sale at public auction on February 6, 2024, at 10:15 a.m., at the North Walker Street entrance to the Mercer County Courthouse, Princeton, West Virginia:

All of the following described lot or parcel of land, together with the improvements thereon, situate and being in the City of Princeton, Mercer County, West Virginia, which said lot is situate on the north side of Princeton Avenue, in said city, and is known as the whole of Lot No. 7, Section No. 20, of the Bee Addition, and 20 feet off of the west side of Lot No. 8, Section 20 of the said Bee Addition to the said City of Princeton, as shown on the Map of said Addition of record in the County Court Clerk’s Office of Mercer County, West Virginia, in Map Book No. 1, at Page 91, and which said parcel of real estate fronts 50 feet on the north side of said Princeton Avenue and runs thence back between parallel lines 129 feet to an alley.

AND BEING the same property conveyed unto Kalpeshkumar Patel by deed of Joe L. Fincher and Earnestteen Fincher, husband and wife, dated the 17th day of March, 2011, said deed to be recorded simultaneously herewith in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

This conveyance is made expressly subject to all pertinent restrictions, reservations and easements of record.

The deed of trust states that the address of this real estate is commonly known as 416 Princeton Avenue, Princeton, West Virginia 24740.
J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated December 28, 2023, of record in said Clerk’s Office in Trust Deed Book 1468, at page 116.
This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanic’s and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.
TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by deed without any warranty, expressed or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
