TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 8, 1996, and duly recorded in the Office of the Clerk of the County Commission of Wyoming County, West Virginia, in Book No. 185, at Page 765 and modified in Document No. 162627, in Book No. 273, at Page 532, Jeffrey P Greene and Kara B Greene did convey unto John Ballengee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR RCF2 ACQUISITION TRUST to foreclose thereunder, will offer for sale at public auction at the front door of the Wyoming County Courthouse in Pineville, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 10 – Slab Fork District, Wyoming County, West Virginia, and more particularly described as follows:

Situate, lying and being on Laurel Fork of Clear Fork near the Town of Glen Fork, Slab Fork District, Wyoming County, West Virginia, and more particularly bounded and described as follows:
BEGINNING on a Hub on the southern boundary of West Virginia Road No. 1, and being the Northeastern corner of the 1.11 acre tract; thence leaving state boundary and with the Eastern boundary line of said 1.11 acre tract, S. 13° 20’ W. 227.41 feet, passing a cinder block planted in the center line of the old Virginian and Western Railway right-of-way at Station 283 + 27.4 to a Hub on the south boundary line of the old Virginia and Western Railway right of way, and being the Southeastern corner of said 1.11 acre tract; thence with the Southern boundary line of said 1.11 acre tract, S. 83° 53’ W. for 50 feet, a chord distance on said right-of-way line thence leading the Southern boundary line and traversing said 1.11 acre tract in a Northerly direction for a distance of 200 feet, more or less, to a point in the Northern boundary line of said 1.11 acre tract on the southern boundary of West Virginia Road No. 1’ thence with said right-of-way line in an Easterly direction for a distance of 116 feet to the point of beginning, and containing 0.41 of an acre, more or less, and being a part of that 1.11 acre tract of real estate as the same is shown and designated on that certain map or plat of record in the Office of the Clerk of the County Commission of Wyoming County, West Virginia, in Deed Book No. 259, at page 367.
And by recent resurvey being more particularly bounded and described as follows:
A parcel of land located on Laurel Fork of Clear Fork near the Town of Glen Fork, West Virginia. More particularly bounded and described as follows:
BEGINNING At a Car Axle found on the southern R. O. W. of WV Rt. 1; THENCE. S 13° 20’ 00” W 227.41’ to an Iron Pin set in the southern R. O. W. of the old Virginia and Western Railway; THENCE, with said R. O. W. S. 80° 08’ 37” W. 50.28’, a chord distance to an iron Pin set in said R. O. W.; THENCE, leaving said R. O. W. N. 03° 19’ 48” W 209.66’ to an Iron Pin set on the southern R. O. W. of WV Rt. 1; THENCE, with said R. O. W. N. 79° 46’ 46” E. 116.00’ to the point of beginning. Total area 17,337 sq. ft. or 0.40 acres, more or less. All as shown on that certain survey dated October 10, 1996, prepared by Michael D. Rose, Licensed No. 841.
Further, and for the consideration aforesaid, the Grantors do also grant and convey all of their right, title and interest in and to that certain private driveway leading from West Virginia Route 1 to the property herein described, as said driveway is shown more particularly shown on that certain plat of survey for Jeffrey & Kara Green, attached to and made a part of hereof for all appropriate purposes.
And being the same property conveyed to the parties of the first part by that certain Deed from Gene Roger Brown, dated July 21, 1995 and of record in the Office of the Clerk of the County Commission of Wyoming County, West Virginia in Deed Book 383, at page 615.
This Deed of Trust is made and accepted subject to all prior reservations, restrictions, covenants, and conditions granted or reserved by all predecessors in title, except those pertaining to race, color or creed.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: Rt 1, Glen Fork, WV 25845.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
