Notice is hereby given that BAYSTAR COAL COMPANY, INC., PO BOX 1084, 356 S COLLEGE AVE, BLUEFIELD, VA 24605 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 19.69 acres and has submitted an application to the DEP, 1159 Nick Rahall Greenway, Fayetteville, WV 25840, for renewal of Article 3 Permit Number U002884 to operate an underground coal mine and refuse disposal area in the Beckley seam of coal. The operation is discharging into an unnamed tributary of Big Creek of Jacobs Fork of Dry Fork and Upper Trace Fork of Jacobs Fork of Dry Fork and Jacobs Fork of Dry Fork of Tug Fork River and is located 1.50 miles, notheast of CUCUMBER in BIG CREEK District of McDowell County, Longitude 81o38’32” and Latitude 37o19’6” (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until March 29, 2024 or thirty (30) days from the date of final publication.
