TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 31, 2008, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5033, at Page 6273, Oliver N. Cochran and Edith R. Cochran did convey unto Mark Wheeling, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

February 29, 2024, at 1:47 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Richmond District, Raleigh County, West Virginia, and more particularly described as follows:

That certain tract or parcel of land lying on the waters of Sal Willis Branch of Glade Creek of New River in Richmond District, Raleigh County, and situate four miles northeast of Shady Spring, West Virginia, and being more particularly bounded and described as follows:

BEGINNING at a ¾ inch iron pipe set in the eastern line of a public road, said point situate N 34 degrees 11’ W. 230.1 feet from a 12 inch Cherry Tree, which said Cherry Tree is standing in the property divisional line between Earl P. Cochran and Noah Crotty; thence with the eastern side of said public road N 21 degrees 45’ 00” W. 250.49 feet to an ½ inch iron pipe set; thence leaving said public road and through the property of Earl P. Cochran the following: N 77 degrees 24’ 50” E. 143.02 feet to a 5 inch Locust Tree, marked as a corner; thence S. 74 degrees 54’ 55” E. 352.83 feet to a Double 8 inch and 12 inch Beech Tree, marked as a corner; thence S 24 degrees 10’ 15” W. 148.00 feet to a 24 inch Black Oak Tree, marked as a corner; thence S 81 degrees 21’ 10” W. 128.76 feet to a fence post, marked, thence S 84 degrees 57’ 20” W. 200.31 feet to the point of BEGINNING, and containing 2.0 acres.

The improvements thereon being commonly known as 322 Willow Branch Road, Shady Spring, West Virginia, 25918.

Being the same lot or parcel of ground which by Deed dated December 13, 1985 and recorded among the land Records of Raleigh County in Deed Book 705, Page 21 was granted and conveyed by Earl P. Cochran and Eunabell Cochran unto Oliver N. Cochran and Edith R. Cochran.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 322 Willow Branch Road, Shady Spring, WV 25918.

AND BEING the same real estate which was conveyed to Oliver N. Cochran and Edith R. Cochran, by Deed dated December 13, 1985, from Earl P. Cochran and Eunabell Cochran, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 705, at Page 21.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
