Notice is hereby given that MID-VOL COAL SALES, INC. 640 CLOVER DEW DAIRY RD, PRINCETON, WV 24739 has submitted an application to the Department of Environmental Protection (DEP), Division of Mining and Reclamation (DMR) located at 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for an Article 3 permit for the surface disturbance of approximately 203.51 acres in order to Area Surface Mine, Contour, Highwall Mine Original Permitted Area = 792.20 with the addition of 203.51 for a total of 995.71 acres in the Pocahontas No. 9, Lower Horsepen, Pocahontas No. 10, Pocahontas No. 11, Pocahontas No. 12, Pocahontas No. 13 and all splits and therof seam of coal. The proposed operation is discharging into Upper Belcher Branch and Unnamed Tributaries of Upper Belcher Branch, of Elkhorn Creek, Harmon Branch and Unnamed Tributaries of Harmon Branch, and Turnhole Branch all of the Tug Fork River of Big Sandy River and is located 2.0 miles, Northeast of Thorpe in Adkin and Browns Creek District of McDowell County, Longitude 81o30’17” Latitude 37o23’44”

Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until March 30, 2024, or thirty (30) days from date of final publication.
