The object of the above entitled action is a Wrongful Occupation of Residential Rental Property or Factory-Built Home Site. Tenant owes an outstanding balance of Five Thousand Two Hundred Eighty-Seven Dollars and Fifty Cents ($5,287.50). Gardner Estates is requesting the following additional relief: back rent and possession
And it appearing by an affidavit filed in this action that even after using due diligence, the plaintiff was unable to discover the residence or whereabouts of the defendant. The defendant was not served, either personally or by way of service upon appropriate family member, after service was twice attempted by the Sheriff of the county in which the defendant resides or is located. It is ordered that Kasey Nichols do serve upon Michael Crowder, magistrate, whose address is 120 Scott Street, Suite 103, Princeton, WV 24740, an answer or other defense to the complaint filed in this action on or before March 11, 2024 at 10:00 am, otherwise judgment by default will be taken against Kasey Nichols at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at her office.
