The object of the above entitled action is a Civil Summons: Wrongful Occupation of Residential Rental Property or Factory-Built Home Site. The Tenant is in arrears in the payment of periodic payments of other charges related to the tenancy: Outstanding Balance of $3,272.38 for unpaid rent.
And it appearing by an affidavit filed in this action that even after using due diligence, the plaintiff was unable to discover the residence or whereabouts of the defendant. The defendant was not served either personally or by way of service upon an appropriate family member, after service was twice attempted by the Sheriff of the county in which the defendant resides or is located. There are or may be persons, other than those named in the complaint as plaintiff and defendat, interested in the subject matter of the action, whose names are unknown to the plaintiff and who are made defendants by the general description of unknown defendants. It is ordered that Samantha Midkiff do serve upon William F Holroyd, magistrate, whose address is 120 Scott Street, Suite 103, Princeton, WV 24740, an answer or other defense to the complaint filed in this action on or before April 3, 2024 at 9:30 am, otherwise judgment by default will be taken against Samantha Midkiff at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at her office.
