NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated March 9, 2001, executed by the Borrower(s), Douglas G. Baker, Jr. and Rita Baker, to Title First Agency, the Trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 883, at Page 785, and re-recorded in Book 1262, at Page 384. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 505 4th St., Bluefield, WV 24701. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated January 9, 2015, of record in the Clerk’s Office in Book 1328, at Page 90. The Borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

April 15, 2024, at 12:00 p.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Bluefield District, Mercer County, West Virginia, and being more particularly described as follows:

All of those certain lots or parcel of land situated in the City of Bluefield, Beaver Pond [now Bluefield] District, County of Mercer, State of West Virginia, bounded and described as follows: to wit:

Parcel No.1: Lot 15 Section 322 (52 X 84) Fourth and Hoge St., Bluefield Beaver Pond District.

Parcel No. 2: The Northern Portion of Lot 18 Section 322 bounded and described as follows:

BEGINNING at a stake on the West side of Hoge Street N. 16° 30’ W. 49.3 feet from the intersection of the West line of Hoge Street with the Northern line of Fifth Street; thence with the West line of Hoge Street, N. 16° 30’ W. 60.6 feet to a stake in the West line of said street, thence S. 66° 35’ W. 73.54 feet to a stake in the dividing line between Lots 17 and 18, Section 322; thence with said division line S. 22° 35’ E. 48.64 feet to a stake dividing the Northern section from the Southern section of Lot 18, Section 322; thence with the said division line N. 81° 43’ E. 67.6 feet to the point of beginning.

Parcel No. 3: “Lot No. 9 and a portion of Lot 17 Section 322, as shown on the official map of the said City of Bluefield, West Virginia, bounded and described as follows:

BEGINNING at a point in the Southern line of Fourth Street S. 67° 00’ W. 52.17 feet distance from the point of intersection of the Southern line of said street with the Western line of Hoge Street, said point being the Northwest corner of Lot 15 Section 322; thence along and with the Western line of said Lot 15, S. 16° 15’ E. 84.0 feet to a point in the Northern line of Lot 18 Section 322, and at the Southwest corner of said Lot 15; thence along and with the Northern line of Lot 18 Section 322, S. 67° 00’ W. (S. 66° 35’ W.) 21.37 feet to a point, the Northwest corner of Lot 18 and the Northeast corner of Lot 17 Section 322; thence along and with the common lot line separating said Lots 17 and 18 Section 322, S. 22° 35’ E. 23.74 feet to a point; thence with a line running through Lot 17 Section 322, S. 67° 25’ W. 50 feet to a point in the common lot line separating Lots 16 and 17 Section 322; thence along and with said common lot line separating said Lots 16 and 17 Section 322, N. 22° 25’ W. 23.51 feet to a point in the Southern line of Lot 8 Section 322; thence along and with the Southern line of said Lot 8, N. 67° 00’ E. (N. 66° 35’ E.) 32.26 feet to a point, the Southwest corner of Lot 9 and the southeast corner of Lot 8 Section 322; thence along and with the common lot line separating said Lots 8 and 9 Section 322, N. 16° 15’ W. 84.0 feet to a point in the Southern line of Fourth Street, said point being the Northwest corner of Lot 9 and the Northeast corner of Lot 8 Section 322; thence along and with the Southern line of Fourth Street, N. 67° 00’ E. 39.12 feet to the beginning”. Lot 9 Section 322 above described is also shown on a map and known as Lot 2 Section 5 of the Jones-McClaugherty survey and is recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book No. 24 at Page 445; and Lot 17 Section 322 is shown on a map entitled “Map of property of John M. Wirgman, Bluefield, West Virginia, Part 2 – West of Mercer Street, Scale 1” = 100 feet 1908. Wm. H. Ford, C.E. Philadelphia”. The above conveyance covers the Northern approximately 23-1/2 feet of Lot 17, Section 322, the remaining portion of Lot has heretofore been excepted and reserved by prior owners.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
