TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 19, 2007, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Document No. 2007510684, in Book No. 810, at Page 494, Ronald R Skeens did convey unto Janet Phillips, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by UMB BANK, National Association, not in its individual capacity, but solely as Legal Title Trustee of PRL Title Trust II to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 – Oak Hill District, Fayette County, West Virginia, and more particularly described as follows:

The following described tract or parcel of real estate situate in the City of Oak Hill, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: Beginning at an old fence post and iron pin on the western side of Noble Street, and same being common corner to Jr. Arrington; thence with the western side of said street, N. 31 degrees 15 minutes W 76.60 feet to an iron pin; thence leaving Noble Street and with a new line through the original tract, S 64 degrees 41 minutes W 104 feet to an iron pin; thence N 31 degrees 08 minutes W 79.98 feet to an iron pin on line of Noble; thence with same S 53 degrees 37 minutes W 33.19 feet to an iron pin, corner to original tract; thence leaving said Noble and with line of Nallen, formerly Slaven heirs S 37 degrees 11 minutes E 145.41 feet to an old fence post and iron pin, and same being corner to Junior Arrington; thence leaving said Nallen and with Arrington, N 67 degrees 59 minutes E 122.90 feet to the point of beginning and containing 11,326 square feet or 0.26 of an acre, as shown on current plat of survey by W. R. Bennett, R.P.E. dated April 14, 1978 recorded in Deed Book 369, at page 636 Map 37 and Parcel 61
Being the same fee simple property conveyed by Deed from Ernest G. Nowlin to Ernest G. Nowlin and Ronald R. Skeens, dated 04/29/1999 recorded on 05/04/1999 in Book 0558, page 0382 in Fayette County Records, State of WV.
There is excepted and reserved from this conveyance that certain 486 square foot parcel conveyed unto E.G. Nowlin, et ux, deed of Roy Edward Fowler, Jr., et ux dated the 17th day of July 1979, and recorded in the aforesaid Clerk’s Office in Deed Book 381, at Page 665, to wit: Beginning at a point, northeast corner of Fowler tract; thence S 53-37’W 33.19 feet to a pin corner to Nowlin; thence with the former line of Nowlin and Fowler S 37-11’ E 15 feet to a point; thence N 53-37’ E 31.60 feet to a point; thence with the line of Nowlin .21 acre tract, N 31-08’ W 15.06 feet to the point of beginning and containing 486 square feet.
This instrument is made subject to all lawful restrictions, reservations, covenants and conditions, made and contained in prior deeds in the chain of title to the above described real estate.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 202 Noble Street, Oak Hill, WV 25901.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
