LEGAL NOTICE
REQUEST FOR PROPOSALS FOR RIGHT-OF-WAY
NEGOTIATOR

The City of Bluefield, Mercer County, West Virginia is in the process of obtaining proposals from right-of-way negotiators to complete the Midway Sewer Replacement Project. The selected right-of-way negotiator will work closely with the city, sanitary board, Region I Planning & Development Council, project attorney, and project engineer to obtain all necessary rights-of-way and parcels.

Procurement of the said services shall be in accordance with 2 CFR 200.320(b)(2). Contracts are to be awarded on familiarity with and expertise on this type of project, as well as on a fixed basis for services. All those interested in being considered for this must submit a proposal detailing qualifications and staffing capabilities, related prior work experience, fee schedule, not-to-exceed proposal amount, and ability to complete work as needed on this project in a timely manner.

Contracts will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project; price and other factors considered including familiarity and expertise with this type of project. The consultant’s eligibility to receive federal funds will be verified at http://www.sam.gov prior to contract award.

If interested in providing this service, please submit an original, three copies, and a digital submission of all requested information to the City of Bluefield, and one copy and a digital submission to Region I Planning & Development Council no later than 4:00 p.m. on April 5, 2024.

Attention is directed to the fact that the proposed project may be undertaken through funding sources including but not limited to the HUD/Community Development Block Grant, WVDEP – CWSRF Loan, and WV Infrastructure and Jobs Development Council.

All work will be performed in accordance with the regulations issued by the funding agencies and the State of West Virginia appertaining thereto. The selected firm(s) will be required to comply with Executive Order 11246, Conflict of Interest Statement and Access of Records, Title VI and Section 109.

The City of Bluefield will afford full opportunity for minority business enterprises to submit a show of interest in response to this invitation and will not discriminate against any interested firm or individual on the grounds of race, color, creed, sex, age, handicap, or national origin in the contract award.

The City of Bluefield reserves the right to accept or reject any and/or all proposals. The City of Bluefield also reserves the right to negotiate the fee for services.
