TRUSTEE’S SALE OF 107 CALVIN STREET, BLUEFIELD, VA 24605. In execution of a certain Deed of Trust dated August 31, 2015, in the original principal amount of $73,150.00 recorded in the Clerk’s Office, Circuit Court for Tazewell County, Virginia, in Book 2015 at Page 13153 as Instrument No. 150002546. The undersigned Substitute Trustee will offer for sale at public auction in the front of the Circuit Court building for Tazewell County, 101 Main Street, Courthouse Building, Tazewell, Virginia, or any such temporary alternative Circuit Court location designated by the Judges of the Circuit Court, on April 22, 2024, at 12:30 PM, the property described in said Deed of Trust, located at the above address, and more particularly described as follows: ALL THOSE TWO CERTAIN LOTS OR PARCELS OF LAND, TOGETHER WITH THE IMPROVEMENTS THEREON AND APPURTENANCES THEREUNTO BELONGING, SITUATE, LYING AND BEING IN THAT SECTION OF THE TOWN OF BLUEFIELD, TAZEWELL COUNTY, VIRGINIA, KNOWN AND REFERRED TO AS “WEST GRAHAM”, AND WHICH SAID PARCELS OF REAL ESTATE ARE MORE PARTICULARLY IDENTIFIED AS FOLLOWS, TO-WIT: LOTS NUMBER NINE (9) AND TEN (10), IN SECTION NUMBER (14), AS THE SAME APPEAR UPON A MAP OF THE WEST GRAHAM LAND AND IMPROVEMENT COMPANY, WHICH MAP IS RECORDED IN THE OFFICE OF THE CIRCUIT COURT OF TAZEWELL COUNTY, VIRGINIA, IN DEED BOOK NO. 33, AT PAGE 123, ET SEQ., TO WHICH MAP REFERENCE IS HEREBY MADE. THIS CONVEYANCE IS MADE SUBJECT TO ANY AND ALL EASEMENTS, CONDITIONS, RESTRICTIONS AND COVENANTS NOW OF RECORD IN SAID CLERK`S OFFICE, TO THE EXTENT THAT THE SAME MAY LAWFULLY AFFECT THE PROPERTY HEREIN CONVEYED AND SUBJECT TO SUCH MATTERS AS WOULD BE REVEALED BY A CAREFUL INSPECTION OF THE PREMISES. TERMS OF SALE: ALL CASH. A bidder’s deposit of ten percent (10%) of the sale price or ten percent (10%) of the original principal balance of the subject Deed of Trust, whichever is lower, in the form of cash or certified funds payable to the Substitute Trustee must be present at the time of the sale. The balance of the purchase price will be due within fifteen (15) days of sale, otherwise Purchaser’s deposit may be forfeited to Trustee. Time is of the essence. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled to a return of the deposit paid. The Purchaser may, if provided by the terms of the Trustee’s Memorandum of Foreclosure Sale, be entitled to a $50 cancellation fee from the Substitute Trustee, but shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee’s attorney.
