In execution of the Deed of Trust in the original principal amount of $62,000.00 dated March 21, 1995 and recorded as Instrument No. 9500923, Book 690, Page 171 of the Tazewell County land records, the appointed Substitute Trustee will offer for sale at public auction at main entrance of the Circuit Court for Tazewell County located at, 135 Court Street, Tazewell, Virginia 24651 on April 10, 2024 at 12:30 PM, the property described in said deed of trust, located at the above address and more particularly described as follows:

All that certain lot or parcel of land situate East of Gratton in Jeffersonville Magisterial District, Tazewell County, Virginia, and being more particularly described as follows:

BEGINNING at a point in the North boundary line of State Route 61 located N. 61 deg. 55’ E. 12.44 feet; thence N. 63 deg. 49’ E. 10.04 feet from a concrete highway marker, and being the Southwest corner of land of Virgil G. Beavers; thence from the point of beginning, N. 21 deg. 00’ W. 162.38 feet to a point being the Northwest corner of said Beavers; thence S. 69 deg. 00’ W. 90.0 feet to a point; thence S. 21 deg. 00 E. 172.93 feet to a point in the North boundary line of said State Route 61, which point is located S. 61 deg. 55’ W. 67.74 feet from the aforesaid concrete highway marker; thence N. 61 deg. 55’ E. 80.18 feet to a point in the North boundary line of said State Route 61, which point is located N. 61 deg. 55’ E. 12.44 feet from the aforesaid concrete highway marker; thence N. 63 deg. 49’ E. 10.04 feet to the BEGINNING.

The property herein conveyed is the same real estate acquired by Deborah Y. Smith, Single, from Jerry Douglas Kidd, Jr. and Angela L. Kidd, Husband and Wife, by deed dated March 21, 1995, and recorded in the Clerk’s Office of the Circuit Court of Tazewell, County, Virginia as Instrument No. 9500922, in Book 690, Page 169.

The property and improvements will be sold in “as is” physical condition without warranty of any kind.

TERMS OF SALE: A non-refundable bidder’s deposit of 10% of the sale price or 10% of the original principal amount of the subject Deed of Trust, whichever is lower, by cashier’s or certified check, required at time of sale except for the party secured by the Deed of Trust. Risk of loss on purchaser from date and time of auction. Balance of the purchase price must be paid by cashier’s check within 15 days from sale date. Except for Virginia Grantor’s tax, all settlement costs and expenses are purchaser’s responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney’s fees of both sales. If Trustee does not convey title for any reason, purchaser’s sole remedy is return of deposit without interest. This sale is subject to post-sale audit by the Substitute Trustee of the conduct of the auction itself as well as the status of the loan secured by the Deed of Trust, including, but not limited to, determining whether prior to sale a bankruptcy was filed, a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest.
