LEGAL NOTICE
REQUEST FOR PROPOSALS FOR ACCOUNTANT/ATTORNEY/PSC ATTORNEY/
BOND COUNSEL/APPRAISER/REVIEW APPRAISER/RIGHT-OF-WAY NEGOTIATOR

The City of Welch, McDowell County, WV is in the process of obtaining professional services necessary to complete the Welch CSO 5 Removal Project and the Welch CSO 2 Removal Project. These services include Accountant, Attorney, PSC Attorney, Bond Counsel, Appraiser, Review Appraiser, and Right-of-Way Negotiator. The selected consultants will work closely with all team members including the City of Welch, Thompson & Litton Engineering, and Region I Planning & Development Council.

The selected Appraiser, Review Appraiser, and Right-of-Way Negotiator will work closely with the project attorney, engineer and administrator to obtain all necessary right-of-ways and parcels.

The selected Accountant will provide accounting services to prepare Rule 42 Exhibit to accompany the application for Certificate of Convenience and Necessity to the West Virginia Public Service Commission as well as any other services needed in relation to the project.

The selected Project Attorney and PSC Attorney will provide general legal services as necessary during the development and construction of the project. Areas of practice include obtaining Certificate of Convenience from the West Virginia Public Service Commission, title work as necessary to obtain construction right-of-ways and parcels and review of all contract and related documents as necessary.

Procurement of said services shall be in accordance with 2 CFR 200.320(b)(2). Contracts are to be awarded on familiarity with and expertise on this type of project, as well as on a fixed basis for services. All those interested in being considered for this must submit a proposal detailing qualifications and staffing capabilities, related prior work experience, fee schedule with a total not-to-exceed amount, and ability to complete work as needed on this project in a timely manner.

Contracts will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project; price and other factors considered including familiarity and expertise with this type of project. The consultant’s eligibility to receive federal funds will be verified at http://www.sam.gov prior to contract award.

Attention is directed to the fact that the proposed project may be undertaken through funding sources including but not limited to the HUD/Community Development Block Grant (CDBG), Appalachian Regional Commission (ARC), WV Infrastructure and Jobs Development Council (WVIJDC), US Department of Agriculture Rural Development Persistent Poverty Grant (USDA), Department of Environomental Protection CWSRF Principal Forgiveness Loan (DEP), and local funds.

The City of Welch will afford full opportunity for minority business enterprises to submit a show of interest in response to this invitation and will not discriminate against any interested firm or individual on the grounds of race, color, creed, sex, age, handicap or national origin in the contract award.

The City of Welch reserves the right to accept or reject any and/or all proposals. The City of Welch also reserves the right to negotiate the fee for services.
