TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 10, 2017, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 1183, at Page 727, Kevin P. Schneider and Eileen Mae Schneider did convey unto Resource Partners Group, LLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

May 3, 2024, at 10:00 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Fairmont City District, Marion County, West Virginia, and more particularly described as follows:

Parcel One: All that certain lot or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate in the City of Fairmont, Fairmont District, Marion County, West Virginia, in Deed Book No: 348, at Page 247 and being more particularly bounded and described as follows:

All of Lot Number Eight (8) of said Wise Mine Property beginning at a point in the northern line of Ogden Avenue extended, distant thereon eastwardly 109.06 feet from the center line of Baltimore Street in said City of Fairmont, said point being a corner to Lot No. 7 of Wise Mine Property; thence with the eastern line of said Lot No. 7, N. 15° 37’ W. 140 feet to a point in the southern line of Lot No. 6, N. 66° 30’ E. 60 feet to a point, a corner to Lot No. 9 on said plat; thence with the western line of said Lot No. 9, S. 15° 37’ E. 140 feet to a point in said northern line of Ogden Avenue extended; and thence with said northern line of Ogden Avenue extended, S. 66° 30’ W. 60 feet to the place of beginning.

Parcel Two: All that certain strip or sliver of real estate situate in the Riverview Improvement Company’s Wise Mine Property, in the City of Fairmont, Fairmont District, Marion County, West Virginia, being part of Lot No. 9 of said Addition, and identified as Parcel A on that certain plat prepared by Norman L. Kronjaeger, P.S. 804, entitled “Plat Showing Proposed Subdivision of Lavota Linear Property Riverview Improvement Co., City of Fairmont, Marion County, West Virginia”, dated July 2010, attached to a deed of record in the aforesaid Clerks Office in Deed Book No. 1072, at Page 825, and to which reference is hereby made for all pertinent purposes, which strip or sliver of real estate conveyed is more particularly bounded and described as follows:

Beginning at a 5/8” iron pin with cap marked “TRIAD”, in the northern line of Ogden Avenue, being the southeastern corner of Lot No. 8 of Riverview Improvement Company Wise Mine Property, a plat of which Wise Mine Property is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 348, at Page 247, and running with northern line of Ogden Avenue N. 66° 30’ E. 4 feet; thence with a line through Lot No. 9 of said Wise Mine Property, being Parcel One in Deed Book No. 915, at Page 56, N. 25° 08’ 12” W. 140.06 feet to an iron pin, which is northeastern corner of Lot No. 8 of said Wise Mine Plat, thence with line of Lot No. 8, S. 23° 30’ E. 140 feet to the place of beginning, being 280 square feet, more or less.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 902 Ogden Avenue Ext., Fairmont, WV 26554.

AND BEING the same real estate which was conveyed to Kevin P. Schneider and Eileen Mae Schneider, by Deed dated December 2, 2013, from Matthew Lawrence Childers and Sarah Childers, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1147, at Page 512.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
