TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 21, 2015, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 1117, at Page 739, Zachary Bailey did convey unto Compton and Associates, PLLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Lincoln District, Marion County, West Virginia, and more particularly described as follows:

All that certain lot or parcel of real estate lying and being situate in the Lincoln District, Marion County, West Virginia, and being more particularly described as follows, to-wit:

Beginning at a Stone on the ridge, corner to Jas. Strum and J. Blackshere, thence with a part of the line between Jas. Sturn and M.M. Martin S. 42 ¼ W. 32 poles to a Stake; thence leaving with the original line, S. 59 ½ E. 49 ¾ poles to a Locust; thence S. 54-30 E. 7 ¼ poles to a post; thence S. 24-50 W. 1.95 poles crossing a small drain to a Stone; thence S. 64 ¼ E. 13 ¾ poles crossing county road and stream to a stake in the original line; thence with the original survey, N. 22 E. 37 ½ poles to a stake on the bank of drain near a White Oak; thence N. 4 W. 19.80 poles to a Stone; thence N. 84° W. 51.20 poles to a stone and thence N. 20 W. 1.66 poles to the place of beginning, containing 19.81 acres more or less.

There is excepted and reserved that certain right of way conveyed to Eastern States Oil & Gas, Inc. by deed dated the 17th day of August, 1999 of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in deed Book 956, Page 921.
There is excepted and reserved that certain right of way conveyed to Exploration Partners, LLC, a West Virginia limited liability company by deed dated the 29th day of March, 2001, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 967, Page 886.

Being certain real estate conveyed to Victor W. Strother and Alice Leona Strother by deed dated the 25th day of September, 1950, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 494, Page 60. Thereafter, the said Victor W. Strother died December 27, 1991 and by the terms of his Last Will and Testament of record in Will Book 87, Page 37, he devised his interest to Alice Leona Strother. Thereafter, the said Alice Leona Strother died May 20, 2005 and by the terms of her Last Will and Testament of record in Will Book 115, Page 120, she devised the property to Sandra K. Malcomb, Timothy Strother, and Angela Ray Musgrove. Thereafter, the said Timothy Strother died intestate May 5, 2014, leaving his sole heirs at law, Jamie Strother and Alan Wayne Strother.

And further being all the same real estate conveyed to the Grantor(s) herein by deed of even date to be recorded simultaneously herewith in the Office of the Clerk of the County Commission of Marion County, West Virginia.

This conveyance is made subject to any and all existing reservations, restrictions, rights-of-way, and conditions as are contained in the chain of title to said property.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 115 Anderson Hollow Road, Mannington, WV 26582.

AND BEING the same real estate which was conveyed to Zachary Bailey, by Deed dated May 21, 2015, from Sandra K. Malcomb, Angela Ray Musgrove, The Estate of Timothy Strother, by Sandra K. Malcomb, Administratrix, Jamie Strother, heir and Alan Wayne Strother, heir, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1173, at Page 216.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
