The object of the above entitled action is a Civil Summons: Wrongful Occupation of Residential Rental Property of Factory-Built Home Site. Tenant breached the terms of the tenancy and the rent therefore Tenant owes an outstanding balance of One Thousand TwoHundred Dollars ($1,200) for unpaid rent.
And it appearing by an affidavit filed in this action that even after using due diligence, the plaintiff was unable to discover the residence or whereabouts of the defendant. The defendant was not served, either personally or by way of service upon an appropriate family member, after service was twice attempted by the Sheriff of the County in which the defendant resides or is located. It is ordered that Donald Smith do serve upon Keith Compton, magistrate, whose address is 120 Scott Street, Suite 103, Princeton, WV 24740, an answer or other defense to the complaint filed in this action on or before June 18, 2024 at 9:00 am, otherwise judgment by default will be taken against Donald Smith at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at her office.
