OF THE COUNTY OF WYOMING, STATE OF WEST VIRGINIA,
PUBLIC SCHOOL BONDS, SERIES 2024
ATTORNEY GENERAL’S APPROVAL

At a regular meeting of the Board of Education for the County of Wyoming, State of West Virginia, held on August 1, 2022, an order was entered of record authorizing a vote to be taken of legal voters of the County of Wyoming at the general election held on November 8, 2022, upon all questions connected with the incurring of debt and issuing bonds in the aggregate principal amount of not more than Twenty Million One Hundred Seventy-Five Thousand Dollars ($20,175,000), and levying taxes to pay the interest on and the principal of said bonds, the proceeds from the sale of such bonds to be used (together with any proceeds from other private or public sources that may be received) for the following school projects:

The Board of Education of the County of Wyoming pursuant to the provisions of Chapter 13, Article 1, Section 25, of the West Virginia Code of 1931, as amended, has caused to be transmitted to me duly certified copies of all orders, ordinances, proclamations, notices, advertisements, affidavits, resolutions and records of all the proceedings connected with or pertaining to such bond issue, and I have examined the same.

1 As approved by the voters, the issuance of the Bonds was contingent upon the Board,s receipt of an award of at least $13,761,250 in grant funds from the School Building Authority of West Virginia or from other funding sources available to the Board in amounts sufficient to undertake and complete the Projects. At its meeting on December 11, 2023, the School Building Authority of West Virginia awarded the Board the amount of $15,711,654 for the construction of a new Mullens PreK-8 School to be located in Mullens, West Virginia. As also approved by the voters, such additional money may be used either in substitution for or in addition to the proceeds of the sale of the Bonds, as may be determined by the Board and the applicable granting body or agency. Accordingly, such funding contingency has been satisfied and, upon the issuance of the Bonds, the Board will have sufficient funds to undertake and complete the Projects.

It appears from the records so transmitted to me that with respect to the proposition of incurring debt and issuing bonds, as provided in said order, Two Thousand Three Hundred Twenty (2,320) votes were cast for and One Thousand Eight Hundred Thirty-Seven (1,837) votes were cast against the issuance of said bonds, so that fifty-five and 81 /100 percent (55.81%) of the voters in said election voted in favor of incurring debt and issuing bonds as provided in said order.

In my opinion, there has been substantial compliance with the law relating to the issuance of said bonds, and I, therefore, approve the validity of such Bond Issue pursuant to the provisions of Chapter 13, Article I, Section 25, of the West Virginia Code of 1931 as amended.
