LEGAL NOTICE
REQUEST FOR PROPOSALS FOR LEGAL SERVICES
The Mercer County Commission, West Virginia is in the process of obtaining legal services necessary to complete the Cumberland Industrial Park Broadband Expansion Project. The Project Attorney will work closely with Mercer County Commission, Region I Planning & Development Council, and Thompson & Litton Engineering.
The Project Attorney is an integral part of the project team and will provide general legal services as necessary during the development and construction of the project. Areas of practice include but are not limited to necessary title work to obtain construction right-of-ways and parcels, and review of all contracts and related documents.
Procurement of said services shall be in accordance with 2 CFR 200.320 (d). The contract will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project, price and other factors considered including familiarity and expertise with this type of project.
All those interested in being considered must submit a proposal detailing qualifications and staffing capabilities, related prior work experience, fee schedule and ability to complete work as needed on this project in a timely manner.
Proposals are to be submitted as follows: one (1) original, two (2) copies, and one (1) digital format submission to Mercer County Commission; and, one (1) copy and one (1) digital submission to Region I Planning & Development Council.

Proposals will be accepted until close of business on March 19, 2021.
Attention is directed to the fact that the proposed project will be undertaken through funding from the HUD/Community Development Block Grant. All work will be performed in accordance with the regulations issued by the funding agency and the State of West Virginia appertaining thereto.
The selected firm will be required to comply with Title VI of the Civil Rights Act of 1964, Executive Order 11246, Section 109 of the Housing and Urban Development Act of 1974, Section 3 of the Housing and Urban Development Act of 1968, Conflict of Interest Statement and Access to Records provisions and all other requirements as they relate to HUD-funded projects.
The Mercer County Commission will afford full opportunity for minority business enterprises to submit a show of interest in response to this invitation and will not discriminate against any interested firm or individual on the grounds of race, color, creed, sex, age, handicap or national origin in the contract award.
The Mercer County Commission reserves the right to accept or reject any and/or all proposals. The Mercer County Commission also reserves the right to negotiate the fee for services.
