NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Willard Elwin Reynolds, to Flynn, Max, Miller & Miller, LC, Trustee dated January 7, 2016, and recorded in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2602, at page 290, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated March 28, 2022, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on May 24, 2022 at 1:19 p.m., at the front door of the courthouse of Cabell County, West Virginia, the real estate conveyed by said deed of trust and situate in Barboursville District, Cabell County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was 6817 River Lick Avenue, Huntington, WV 25705 and being more particularly bounded and described therein as follows: All that certain tract, piece or parcel of real estate situate in Barboursville District, Cabell County, being known as Lot No. 7 on a plat of survey of proposed parcels for Huntington West Virginia Area Habitat For Humanity, being more particularly bounded and described as follows: Beginning at a 51/3″ x 30” rebar with orange plastic cup stamped ”David A. Lee WV PS 2248″ (found), on the southerly right-of-way line of River Lick Avenue (30′ R ) extended, marking a comer common to the lands of Huntington-West Virginia Area Habitat For Humanity, Inc. (D.8. 1222, Pg. 649) (hereinafter HWVAHFH) and the lands herein conveyed, said rebar bears N 77DEGREES 30′ 00″ E 225.20 feet from a 51/3″ x 30″ rebar with orange cup stamped “David A. Lee WV PS 2248” (found) at the northeast corner of Lot No. 39, as shown on the plat of “Victory Land Co. Subdivision, Pineview”, recorded in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Map Book 5 as Map No. 75; thence, with the said southerly right-of-way line of River Lick Avenue, N 77DEGREES 30′ 00″ E 60. 76 feet to a 51/3″ x 30″ rebar with orange plastic cap stamped “David A. Lee WV PS 2248″ (found) in the westerly line of the lands of Betty M. Duncan (D.B. 555, Pg. 261), said rebar bears S 10DEGREES 12’36” E 5.4 I feet from a 51/3″ rebar with pink plastic cap stamped “JLE PLS 2067″ (found); thence, leaving the said southerly right-of-way line of River Lick Avenue with the lands of the said Duncan, S 10DEGREES 12′ 36″ E 129.86 feet to a 51/3″ x 30″ rebar with pink plastic cap stamped ”David A. Lee WV PS 2248″ (set), marking a corner common to the lands of J. Roger Smith, et ux (D.B. 1016, Pg. 367), said rebar bears N 10DEGREES 12′ 36″ W 43.00 feet from a 2″ iron pipe (found) at the southwest comer of the lands of the said Duncan; thence, with the lands of the said Smith, et ux, S 85DEGREES 20′ 24″ W 53.08 feet to a 51/3″ x 30″ rebar with pink plastic cap stamped “David A. Lee WV PS 2248″ (set); thence, leaving the lands of the said Smith, et ux and severing the lands of the said HWVAHFH, N 13DEGREES 53 ’57” W 122.55 feet to the beginning, containing 7,153 Sq. Ft., 0.164 acres, as surveyed by David A. Lee, West Virginia Professional Surveyor No. 2248, on May 21, 2015 as shown on the attached plat and made part of’ this description. The above bearings and distances are based on plats of survey recorded in Map Book 5, Map No. 75 and Map Book 11, Map No. 106 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. It is the intent of the foregoing description 10 include a portion of the same property that was described in a deed from J. Roger Smith and Pamela Kay Smith to Huntington-West Virginia Area Habitat For Humanity, Inc., dated October 6, 2010 and recorded in Deed Book 1222, Page 649 and shown on a plat of survey of parcels abutting River Lick Avenue recorded in Map Book 11 as Map No. 106, in the office of the Clerk of the County Commission of Cabell County, West Virginia. This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate. The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale. The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
