PUBLIC SERVICE COMMISSION OF WEST VIRGINIA CHARLESTON ALLIED WASTE SERVICES OF NORTH AMERICA, LLC, DBA REPUBLIC SERVICES OF WEST VIRGINIA CASE NO. 22-0784-MC-TC-AC NOTICE OF FILING On August 23, 2022, RGL, Inc., dba Mountain State Waste (“MSW”) and Allied Waste Services of North America, LLC, dba Republic Services of West Virginia (“Republic”), filed a joint petition to transfer a portion of the operating authority under Motor Carrier Certificate No. 7418 currently held by Republic to MSW, to amend Motor Carrier Certificate No. 7418 to reflect a reduced operating authority and to issue a new certificate number to MSW to reflect the service authority transferred. The Joint Petitioners propose to transfer the following authority, and only the following authority, under Certificate No. 7418 to Mountain State Waste: “to operate as a common carrier by motor vehicle in the transportation of the following types of solid waste and infectious medical waste, as that term is defined in 20-5J-3(5) of the West Virginia Code, from the following counties (or portions thereof) 1 the transportation of solid waste and infectious medical waste from those points and places in Boone County that are located within a radius of five (5) miles of the intersection between W.Va. Route 3 and Boone County Route 37/8; 3 the transportation of solid waste-excluding the transportation of solid waste in commercial service under the container system-and infectious medical waste from those points and places in Kanawha County, west of the Coal River, that are located within a radius of one (1) mile of the point at which the Big Coal River and the Little Coal River merge to form the Coal River; 4 the transportation of solid waste and infectious medical waste from points and places in Lincoln County; 5 the transportation of solid waste from those points and places in Logan County that are located within the former Guyan Magisterial District, as the boundaries of that former Magisterial District are reflected on a 1998 county road map of the northern portion of Logan County that was prepared by the West Virginia Division of Highways, subject to the following exclusions – (a) excluding the transportation of solid waste from those points and places in Logan County that are located within the corporate limits of the City of Logan and of the Town of Mitchell Heights and West Logan; (b) further excluding the transportation of solid waste from those points and places in Logan County that are located within Chief Logan State Park; and (c) further excluding the transportation of solid waste from those points and places in Logan County that are located within a radius of 4.5 miles of the intersection between W.Va. Route 17 and Logan County Route 1191/3 to places of disposal; and 6 the transportation of commercial solid waste with rear load containers and residential solid waste from points and places in Mason County- to places of disposal. The Joint Petitioners propose to amend the statement of Authority under Republic’s Certificate No. 7418 to state as follows: “to operate as a common carrier by motor vehicle in the transportation of the following types of solid waste and infectious medical waste, as that term is defined in 20-5J-3(5) of the West Virginia Code, from the following counties (or portions thereof) – 2 the transportation of solid waste – explicitly including the transportation of solid waste, junk, scrap metal, and discarded building materials in service to residential customers under the container systems – and of infectious medical waste, from points and places in Cabell County, subject to the following exclusions: (a) excluding the transportation of solid waste and infectious medical waste from those points and places in Cabell County that are located inside corporate limits of the City of Huntington as said corporate limits existed as of September 9, 1977, and (b) further excluding the transportation of solid waste under the container system for commercial, industrial, and governmental customers from those points and places in Cabell County that are located to the south of one or both of the following routes: Cabell County Routes 8 and 11; and 6 the transportation of commercial solid waste except commercial service with rear load containers from points and places in Mason County- to places of disposal. Anyone desiring to protest or intervene should file a written protest or request to intervene within ten days following the date of publication unless otherwise modified by Commission Order. Request to intervene must comply with the Commission rules on intervention set forth in the Commission Rules of Practice and Procedure.
