NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned Campbell Woods, PLLC, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Cabell West Virginia, and by Deed of Trust dated June 14, 2019, executed by Andrew J. McKee to Samuel A. Vallandingham and Philip Andrew Vallandingham, Trustees, which deed of trust is of record in the Office of the Clerk of Cabell County, West Virginia, in Trust Deed Book 2743 at Page 230, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee together with Joe R. Pyle Auction & Real Estate Services LLC will sell the real estate described in the Deed of Trust, at a public auction on November 22, 2022, at 12:00 p.m. (Noon) (registration to begin at 11:30 a.m.) to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington, West Virginia, which real estate is more completely described as follows: All that certain lot, piece or parcel of ground situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of Enslow Park Place, a copy of which map is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Map Book No. 3, as Map No. 24, as part of Lot No. Seventy-Nine (79), Section Five (5), and being more particularly bounded and described as follows: BEGINNING at an iron pipe (reset) on the west line of Ritter Boulevard, marking a corner common to Lots Nos. 78 and 79, as shown on the said map; thence, leaving the said Lot No. 78 and with the said Boulevard, as follows: South 03DEGREES 13′ East 55.00 feet to an iron pipe (set); thence, with a curve to the left, having a radius of 72.42 feet for a distance of 24.83 feet, the long chord of which bears; South 13DEGREES 02′ East 24.71 feet to an “X” cut in a concrete driveway; thence leaving the said Boulevard, and severing the said Lot No. 79 as follows: South 56DEGREES 48′ West 32.66 feet to an iron pipe (set), South 87DEGREES 08′ West 63.05 feet to an iron pipe (set) in the west line of the said Lot No. 79, from which an iron pipe (found) marking a corner common to Lots Nos. 79 and 103 bears South 16DEGREES 43′ East 47.00 feet; thence, with the said west line of said Lot No. 79, North 16DEGREES 43′ West 98.00 feet to an iron pipe (found) marking a corner common to the said Lot Nos. 78 and 79; thence, leaving the said west line of the said Lot No. 79, and with the said Lot No. 78, North 86DEGREES 47 East 110.00 feet to the BEGINNING, containing 9,285 square feet, more or less, as surveyed by Ronald L. Eastham & Associates, Inc., on April 24,1979, as shown on map recorded in deed book 800 at page 119, together with an easement 10 feet in width, the centerline of which is the existing sanitary sewer line which extends southerly from the property hereby conveyed through the portion of Lot No. 79, Section 5, Enslow Park Place not hereby conveyed and through Lot No. 103, Section 6, Enslow Park Place to a point where such sanitary sewer line connects with the City sewer, to maintain, operate, repair and replace said sanitary sewer line. TERMS OF SALE 1. The successful bidder (“Purchaser”) shall pay a Ten Percent (10%) nonrefundable down payment payable to the Trustee immediately after the conclusion of the auction with balance due and payable within thirty (30) days from the date of the sale payable by certified check, cashier’s check, or wired funds. In addition to the sales price, the Purchaser will be responsible for a ten percent (10%) “Buyer’s Premium” which will be added to the final bid amount and due at time of sale payable to Joe Pyle Auction & Real Estate Services LLC to determine final aggregate contract price. Remote and r online bidding will also be permitted. Please contact the auction company in advance of the sale to arrange for remote bidding, if available. If remote and r online bidding is permitted and the successful bidder participated remotely and r online, the down payment and buyer’s premium must be paid in full within twenty-four hours of the conclusion of the sale or the Trustee reserves the right to reject the bid. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
