NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS November 2, 2022 West Virginia Housing Development Fund (WVHDF) 5710 MacCorkle Avenue, SE Charleston, WV 25304 (304) 391-8600 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the WVHDF. REQUEST FOR RELEASE OF FUNDS On or about November 18, 2022, the WVHDF will submit a request to HUD for the release of funds from the Section 202 Supportive Housing for the Elderly Program, authorized by section 202 of the Housing Act of 1959 (12 U.S.C. 1701q), as amended to undertake the following project: The project will involve the rehabilitation of The Prichard Building, an existing thirteen-story structure located at 605 9th St, Huntington, WV, 25701. The building will include 108 single- bedroom units serving the elderly on floors three through thirteen while floors one and two will be dedicated to commercial space and medical outreach. The Site will also contain a two-story office building and off-Site parking will be available. The Prichard Hotel Restoration LLLP ornerstone Community Development Corporation intends to rehabilitate the Site by converting the interior of the former Prichard Hotel building from a vacant dilapidated state into a functional senior living and health complex, installing energy star appliances and lights. The project will feature sight earing and mobility-impaired specific units with elevator access. The complex will also include activity areas and mixed institutional ommercial on-residential floors. Prichard Hotel Restoration LLLP ornerstone Community Development Corporation will be responsible for the development of the project. The total estimated cost of the project is $49,761,074, with $3,000,000 in HUD funding under the Section 202 Supportive Housing for the Elderly Program. Funding sources for the project include City of Huntington’s HOME and CDBG-CV programs, WVHDF’s HOME Program and NHTF Program; equity from LIHTC investment; State Historic Tax Credit equity; Federal Historic Tax Credit equity; and HOPE of Kentucky, LLLC. FINDING OF NO SIGNIFICANT IMPACT The WVHDF has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the WVHDF at environmental@ wvhdf.com or at the above address. All comments received by November 17, 2022, will be considered by the WVHDF prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The WVHDF certifies to HUD that Erica Boggess in her capacity as Executive Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows WVHDF to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the WVHDF’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the WVHDF; (b) the WVHDF has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Mr. Phillip E.
