NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of authority vested in the undersigned Trustee by that certain Deed of Trust executed by SKILLET, LLC, a West Virginia Limited Liability Company to Ronald J. Flora, as Trustee, for the benefit of Jimmy R. Smith, dated the 7th day of April, 2021 and of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2830 at Page 580, to secure the payment of certain note set out and described therein, and default having been made in the payment of said note and further the undersigned Trustee having been requested to do so by the holder of said note, shall sell to the highest and best bidder, on 28th day of December, 2022 at 9:30 o’clock a.m., at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, the real estate, conveyed by said Deed of Trust together with the improvements thereon and the appurtenances thereunto belonging, and being more particularly described therein as follows: A tract of land situate on the waters of Mud River, City of Milton, West Virginia, Cabell County, Tax Map 5, parcel 329.4, more particularly described as follows, to wit: BEGINNING at a point, on the south side of U.S. Route 60, 50 feet from center, and being a common comer between Parcel 328 and Parcel 329; thence from said beginning point and parallel to U.S. Route 60, N 82DEGREES 56′ 30″ E 130 feet to a point; thence leaving said Rt. 60 S 56DEGREES 30′ 00″ E approximately 100 feet to the center of Mud River, thence S 82DEGREES 56′ 30″ W 100 feet to a point; thence S 51DEGREES 15′ 00″ W 35.69 feet to a point in the southeasterly comer of said Parcel 328; thence leaving said river N 56DEGREES 30′ 00″ W 100.00 feet to the place of BEGINNING. Being the same property conveyed to Skillet, LLC from Jimmy R. Smith by deed dated April 7, 2021 and which is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia in Deed Book 1440, at Page 740. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied and subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note hereby reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuances shall be the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property, and r any belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF PURSUANT TOW.VA. CODE 38-1-17. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale with ten (10%) of the sales price shall be paid by cash, cashiers check, or check guaranteed by bank letter of credit in acceptable form, in hand on the day of the sale (the “Good Faith Deposit”), with the balance to be paid in cash at closing within 30 days after the date of sale or such Deposit shall be forfeited.
