NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS December 1st, 2022 Planning & Development Department City of Huntington 800 5th Avenue Huntington, WV 25701 304-696-4486 REQUEST FOR RELEASE OF FUNDS On or about December 17th, 2022, the city of Huntington will submit a request to the U.S. Department of Housing and Urban Development for the release of Community Development Block Grant Program- Cares ACT funds and Cabell-Huntington-Wayne Housing Consortium funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake the following project: Barnett Commons (Project) will involve the acquisition and demolition of an existing building and separate, detached garage and the new construction of two multifamily residential buildings to provide a total of 32 low-income units for families and seniors. The Project site is approximately 0.7146 acres and is located at 1524 10th Avenue, Huntington, Cabell County, WV, in Census Tract 0014.00. The Project’s location in the census tract is in a predominately business-use area; however, other multifamily residential developments, single family houses, services, and many convenient amenities are within walking distance. The Project’s proximity to noise generators resulted in a combined DNL of 70 decibels. When the noise assessment is above 65 decibels but not exceeding 75 decibels; the floor may be shifted to 70 decibels in circumstances described in 24 CFR 51.105(a). The Project has satisfactorily achieved omplied with the circumstances described in 24 CFR 51.105(a); therefore, the Project’s floor is shifted to 70 decibels. Barnett Commons L.P., a West Virginia limited liability company, will be responsible for the Project’s development. The Project’s sources include Low-Income Housing Tax Credit Equity, WVHDF Multifamily Loan, HOME Investment Partnerships Program Loan, City of Huntington, WV, HOME Investment Partnerships Program Loan, and deferred developer fee. The estimated total Project cost is $9,315,000. The WVHDF will provide up to a $900,000 HOME Program loan and the City of Huntington will provide up to a $300,000 HOME Program loan, both of which will finance a portion of the construction cost. FINDING OF NO SIGNIFICANT IMPACT The city of Huntington has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Planning & Development Department, City of Huntington, 800 5th Avenue, Huntington, WV 25701 and may be examined or copied weekdays 8 a.m. to 4:30 p.m. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Huntington’s Planning & Development Department. All comments received by December 16th, 2022 will be considered by the City of Huntington prior to authorizing submission of a request for release of funds. Comments should specific which Notice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Huntington certifies to U.S. Department of Housing and Urban Development that Steve Williams, in his capacity as the Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. U.S. Department of Housing and Urban Development approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Huntington to use HUD program funds OBJECTIONS TO RELEASE OF FUNDS U.S. Department of Housing and Urban Development will accept objections to its release of fund and the City of Huntington’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Huntington; (b) the City of Huntington has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by U.S. Department of Housing and Urban Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and should be sent to Phillip E.
