Workman, Unknown Persons wners, and Ross H. Mellinger, Sheriff of Jackson County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation ight of Entry has been filed in the Circuit Court of Jackson County, West Virginia, and is known as Civil Action No. CC-18-2022-C-57, and styled AEP West Virginia Transmission Company, Inc. vs. Walter J. Swann, et al. Said Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of AEP West Virginia Transmission Company, Inc. situate, lying, and being in Ripley District, Jackson County, West Virginia, identified as Tax Map 23, Parcel 13, and recorded in the office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 384, at page 627, and being more specifically bounded and described as follows: BEGINNING at a stone corner to Church and School House lot; thence N. 24-ONE-HALF E. 14 poles to Parchment Road; thence with said road N. 56 W. 30 poles and 12 links to corner of cemetery lot; thence with said Cemetery lot S. 37-ONE-QUARTER W. 9 poles and 9 links to a stone; thence N. 53 W. 10 poles; thence N. 33-31/2 E. 9 poles and 12 links back to the road; thence with said road N. 58-ONE-HALF W. 13 poles; thence leaving said road S. 53 W. 28 poles to a stone corner to Harry Riley Land; thence S. 2-ONE-HALF W. 46 poles and 12 links, corner to Baker land; thence S. 53 W. 97 poles to a stone corner to Stewart land; thence with Stewart’s line S. 34-ONE-HALF E. 116 poles and 18 links to a stone on a hillside corner to Jeff Phillips land; thence N. 36-ONE-HALF E. 39 poles and 1 link to a stone, also corner to Phillips land; thence S. 6 W. 24 poles to a stone corner to Carl Shatto Tract of land; thence with his line N. 87 E. 20 poles to a stone; thence N. 4-ONE-HALF E. 153 poles to a point in the old trail; thence N. 30-ONE-QUARTER E. 32 poles to the place of beginning, containing 106 acres. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation ight of Entry may be obtained from the Jackson County Circuit Clerk’s office at 100 Court Street, Ripley, West Virginia, 25271, for the purposes of appearing and defending. The Petition for Condemnation ight of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation ight of Entry will occur on January 19, 2023, at 1:15 p.m., in the Circuit Court of Jackson County, West Virginia, located at 100 Court Street, Ripley, West Virginia, 25271, before the Honorable Lora Dyer. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
