TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 6, 2009, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Document No. 309486, in Book No. 2276, at Page 349, James P Boardman and Theresa Boardman did convey unto Dru A Shope, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue Entrance of the Cabell County Courthouse in Huntington, West Virginia, on January 24, 2023 at 2:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Grant District, Cabell County, West Virginia, and more particularly described as follows: All that certain piece or parcel of land situate in the Subdivision known as Oakdale Addition to the Town of Culloden, in Grant District, Cabell County, West Virginia, known and designated in a plat of said Oakdale Addition, made by C.C. Lovette & Son, Engineers, dated June, 1940, and recorded in the Office of the County Commission of Cabell County, West Virginia, on June 26, 1940 in Map Book N. 4, as Map No. 46, as part of Lot Number Nine (9), and being more particularly bounded and described as follows: Beginning at an irregularly shaped concrete monument, approximately 6 inches diameter, found at the southwesterly corner of Lot 1 of said Oakdale Addition, thence with the southerly line of Lots 1, 2 and part of 3, N. 89 29′ E, 135.00 feet to a 1-ONE-HALF inch pipe (set), thence leaving the southerly line of said Lot 3 and severing the lands of James A. & Jewell A. Stone (Db 967, P 655), S. 10 45′ 53″ E, 188.35 feet to a 1-ONE-HALF inch pipe (set) in the northerly line of the lands of Junior Arlie & Vonnie L. Curry (Db 859, P 376), thence with the said northerly line of said Curry, S. 68 07′ W., 65.09 feet to a ONE-HALF-inch steel pin in a 6-inch concrete monument (found) common corner to the lands of Luther H. & Lucia Diane Stowers (Db 935, P 207), thence leaving said Curry line and continuing with the northerly line of said Stowers, S. 68 07′ W., 209.91 feet to a 31/2-inch steel rebar (found) in the center of a 6-inch concrete monument approximately ONE-HALF inch northerly from a ONE-HALF inch steel pin (found) in the same 6-inch concrete monument, a point in the easterly line of the Culloden Cemetary, thence leaving said Stowers northerly line and with the said line of the Culloden Cemetary, N. 15 09’30” E., 293.16 feet to the place of beginning, and containing 1.002 acre, more or less, as shown on the plat of survey, to which reference is hereby made. There is also PROVIDED a fifteen (15) foot wide right-of-way along the northerly line of said parcel. The said right-of-way is PROVIDED for the full right to free and unobstructed use by the Grantors, their heirs and assigns, for access, ingress and egress across the said parcel to the remainder of said Lot 9, however this shall in no way limit the right of the Grantor, or his heirs and assigns to use the said right-of-way, There is ALSO PROVIDED, an approximate 12-foot wide right-of-way or easement along the westerly side of this 1.002 acre parcel, said right-of-way was conveyed in a deed of easement from Gladys M. Cromwell, widow, to Luter H. and Lucia Diana Stowers, husband and wife, on March 14, 1994, and a record in Bonds, Contracts and Leases Book 282 at Page 19. The Grantee herein, his heirs and assigns, shall also have full right to free and unobstructed use of both the 15-foot wide and the approximate 12-foot wide rights-of-way mentioned above, and as shown on the plat of survey. There is FURTHER PROVIDED, a 7-foot wide right-of-way or easement for the use by the Grantee in the event that the current access to Church Street is ever blocked by the Trustees of the Culloden Cemetary. The 7-foot wide rights-of-way shall be along the southerly line of Lot 9 and extend to the easterly line of this parcel to Charlie’s Creek Road. Further, the parties of the first part and the parties of the second part covenant and agree that this property shall be used for RESIDENTIAL purposes only, this covenant is to run with the land. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $6000.00 in cash and r certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.
