NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of authority vested in the undersigned Trustee by that certain deed of trust executed by ARBES PROPERTIES AND LAND DEVELOPMENT, LLCand CHAD ARBES to KERRY E. ADKINS and MICHAEL D. STEPHENS,JR., dated the 22ND day of OCTOBER,2020, securing HUNTINGTON FEDERAL SAVINGS BANK, and recorded in the office of the Clerk of the County Commission of CabellCounty, West Virginia, in Trust Deed Book No. 2803, at page 82, by which was conveyed to the said Trustees the hereinafter described real estate, to secure the payment of acertain note set out and described therein, and default having been made in the payment of said note, and the said KERRY E. ADKINS and MICHAEL D. STEPHENS, JR., Trustees, having been requested so to do by the owner and holder of said note, shall sell to the highest and best bidder, on MARCH 1, 2023 at 10:00 AM., at theEAST FRONT DOOR of the CourtHouse of Cabell County, West Virginia, the following described real estate: PARCEL ONE: All that certain piece orparcel of land situate in Barboursville District, Cabell County, West Virginia, adjoining the subdivision known as Wood Lomond, and being described as follows: BEGINNING at a point in the north lineof Parcel No. 161, which point is S. 66 03′ E., 27.47 feet fromthe northwest corner of said Parcel No. 161, as said north line and northwest corner are shown on a map of Section 5, Cascade Land Owners Association, a copy of which map was filed in the Office of the Cabell County Commission Clerk on 19 February 1982, in Map Book 10 as Map 5; thence with theeast line of Parcel No. 158 of Cascade Drive, N. 23 01′ E., 93.56 feet to a point in the curve and south line of said Cascade Drive; thence with said line,curving right southeasterly with a radius of 24.3 feet, a distance of 29.07 feet;thence continuing with what isnow the westline of said CascadeDrive, S. 6 16′ W., 53.56 feet and with threelines of Parcel No. 152, as shown on above said map, N. 83 44′ W., 9 feet; thenceS. 23 57′ W., 23 feet; thence N. 66 03′ W., passing at 6feet the northeast corner of theabove mentioned Parcel No.161, and continuingwith that lipein all, 27.68 feet to the point of BEGINNING, and containing 2350 squarefeet; TOGETHER WITH aperpetual easement for theuse and maintenance of the common wall between the property herein conveyed and the adjoining property on the westerlyside, as the same now exists, for subjacent,adjacent and lateral support, and RESERVING unto Gary Morrison, Inc. a perpetual easement for the use and maintenance of the common wall between theprope1ty herein conveyed and theadjoining prope1ty on thewesterly side, as the same now exists,for subjacent, adjacent and lateral support of the prope1tyadjoining the herein conveyed real estate on the westerlyside, and TOGETHER WITH an easement for electriclines as the same now exist,and. PARCEL TWO: All that certainlot, piece or parcel of land situate in Barboursville District, Cabell County, WestVirginia, adjoining the Subdivision known as Wood Lomond, and being more particularly described asfollows: BEGINNING at a point in the east line of Cascade Drive at the northwest corner of Parcel No. 161,as shown on a Map of Section 5, Cascade Land Owners Association, a copy of which mapwas filed in the Office of the Clerk ofthe County Commission of Cabell County,West Virginia, on February, 1982 in Map Book 10, as Map 5; thence with theeast line of Cascade Drive, N. 23DEGREES 57′ E. 69.39 feet; thence curving right easterly with a radius of 24.3 feet a distance of 39.77 feet; thence leaving Cascade Drive, S. 23DEGREES 01′ W. 93.56 feet to a point in the north line of said Parcel No. 161 of Section 5, Cascade Land Owners Association; thence with said line, N. 66DEGREES 03′ W. 27.47 feet tothe point of beginning, and containing 2400 square feet; TOGETHER WITH a perpetual easement for the use andmaintenance of the common wall between theproperty herein conveyed and the adjoining prope1ty on the easterly side, asthe same now exists, for subjacent,adjacent and lateral support, and RESERVING unto Gary Morrison, Inc., a West Virginia Corporation, a perpetualeasement for the use and maintenance of the common wall between the property herein conveyed and the adjoining property on the easterly side, as the same now exists, for subjacent, adjacent and lateral support of the property adjoining the herein conveyed realestate on the easterly side, and TOGETHER WITH an easementfor electric lines as the same now exist, and RESERVING unto the said Gary Morrison, Inc., aWest Virginia corporation, for the benefit of the property adjoining the hereinconveyed real estate on theeasterly side, and easement for electric line asthe same now exist.
