NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned SuccessorTrustees, James W. Lane, Jr. and Eric M. Johnson, by that certain Deed of Trustmade by StevenMark Lambert, dated January 10, 2006 and recorded January 17, 2006 inthe office of the Clerk of the County Commission of Cabell County, WestVirginia in Trust Deed Book 2059 at page 607, the said SuccessorTrustees acting by virtue of that certain Appointment of Successor Trusteedated January 5, 2023 and recorded January 17, 2023 in the aforesaid Clerk’soffice in Trust Deed Book 414, at page 230, and default having been made in thepayment of the Note secured by the aforesaid Deed of Trust, and having beenrequested in writing by the owner and holder of the Note, will offer for sale,at public auction, to the highest bidder at the front door of the Courthouse ofCabell County, West Virginia, on Tuesday, March 21, 2023 at 10:00 a.m.,all that certain lot, piece or parcel of real property, together withimprovements thereon, situate in Union District, Cabell County, West Virginia,being more particularly bounded and described as follows: BEGINNING at a rock on the east line of the Ohio River County Road, corner to the landsof Thos. C. Adams, and running about 300 yards in an easterly direction withsaid Adams line to a corner a little over the hill, a corner to the JohnShiveley land; thence with the Shiveley line in a westerly direction to acorner of said Shiveley line on the east line of the County Road; thence southalong said County Road about 75 yards to the place of beginning, excepting andreserving that parcel of land conveyed by Golda Bowman et vir to James Bryantand Lois Bryant by deed of April 17, 1952 and of record in Deed Book No. 458 atPage No. 305 in the Office of the Clerk of the County Commission of CabellCounty, West Virginia. At the time of execution of the deed of trust, the grantor represented that theaddress of the property was 6631 Sanns Drive, Lesage, WV 25537. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,”in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including,without limitation, liens for real estate taxes, incinerator, sanitary andsewer charges and liens with priority to the Deed of Trust pursuant to whichthis sale is being conducted. The propertyshall be sold subject to all covenants, restrictions, easements, rights of wayand reservations which may be a matter of record in the aforesaid Clerk’soffice or visible upon the ground. The propertywill be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall beresponsible for paying the recording costs and also the tax on the privilege oftransferring real property (the cost of the tax stamps to be affixed to thedeed). The Successor Trustees and The OhioValley Bank Company shall not be responsible for the removal of any person orpersonal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by publicannouncement at the time and place designated and act by agent in the executionof the sale.
