NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Date of Publication: March 7, 2023 West Virginia HousingDevelopment Fund (WVHDF) 5710 MacCorkle Avenue, SE,Charleston, WV 25304 304-391-8600 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the WVHDF. REQUEST FOR RELEASE OF FUNDS On or after March 23, 2023, the WVHDF will submit a request to the HUD for the release of HOME Investment Partnerships Program(HOME) funds under Title II of the Cranston Gonzalez NationalAffordable Housing Act of 1990, as amended, to undertake the following project: Project Title: Imperial Lofts Purpose: Acquisition of an approximate 1.10-acre parceland the new construction of two (2) buildings containing a total of thirty-six(36) units serving families and seniors. Location: 2133 8th Avenue,Huntington, Cabell County, WV Estimated Cost: Estimated WVHDF HOME funding ofup to $670,000, and estimated total project cost $8,166,700 FINDING OF NO SIGNIFICANT IMPACT The WVHDF has determined that the project will have no significantimpact on the human environment. Therefore, an Environmental Impact Statementunder the National Environmental Policy Act of 1969 (NEPA) is not required.Additional project information is contained in the Environmental Review Record(ERR). PUBLIC COMMENTS Any individual, group, or agency may submit written commentson the ERR to the WVHDF at [email protected] at the above address. All comments received by March 22, 2023, will be considered by theWVHDF prior to authorizing submission of a requestfor release of funds. Comments should specify which Notice they are addressing. RELEASE OF FUNDS The WVHDF certifies to HUDthatErica Boggess in her capacity as Executive Director consents toaccept the jurisdiction of the Federal Courts if an action is brought to enforceresponsibilities in relation to the environmental review process and that theseresponsibilities have been satisfied. HUD’s approval of the certificationsatisfies its responsibilities under NEPA and related laws and authorities andallows Imperial Lofts L.P. to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund andthe WVHDF’s certification for a period of fifteen days followingthe anticipated submission date or its actual receipt of the request (whicheveris later) only if they are on one of the following bases: (a) the certificationwas not executed by the Certifying Officer of the WVHDF;(b)the WVHDF has omitted a step or failed to make a decisionor finding required by HUD regulations at 24 CFR part 58; (c) the grant recipientor other participants in the development process have committed funds, incurredcosts or undertaken activities not authorized by 24 CFR Part 58 before approvalof a release of funds by HUD; or (d) another Federal agency acting pursuant to40 CFR Part 1504 has submitted a written finding that the project is unsatisfactoryfrom the standpoint of environmental quality.
