LEGAL NOTICE REQUEST FOR PROPOSALS FOR LEGAL SERVICES, ACCOUNTING, ADMINISTRATION,RIGHT-OF-WAY, AND BOND COUNSEL SERVICES The Lavalette Public Service District (LPSD), Wayne County,West Virginia, is requesting proposals from qualified consultants to provideprofessional services as they relate to the Big Lynn Water Extension Project. Professional services that are needed include but are notlimited to, the following. 1.GeneralProject Attorney 1.Provide general legal counsel 2.Review all contract and bond documentspertaining to said project 3.Review and prepare any and alllegal documents pertaining to this project. 2.Landsand Rights-of-Way Attorney Review and preparation of all easements including, but not limited to title searches, right of way forms, deeds, andother related legal documents to said Project; and,Research title and preparation of deeds as necessary. 3.PSC Attorney 1.Provide legal services for obtaining aCertificate of Convenience and Necessity from the PublicService Commission of West Virginia. 4.Accountant 1.Reviewof all ledgers and books; 2.Reviewof all cost to project; 3.Completionof Rule 42 Exhibit; and 4.Anyother accounting needs pertaining to this project. 5.Bond Counsel Preparation of all necessary documentation for the financing, including all necessary ordinances, resolutions and all certificates, opinions, and other documents.Attend District meetings to explain the financing process and issuance of bonds.In connection with the closing, render an opinion covering the validity of the Bonds. 6.Project Administrator 1.Assistwith preparation of necessary grant applications. 2.Undertakedirect administration of approved grants, including project implementation,construction administration, financial management ompliance, general grantcompliance, labor compliance, grant closeout. 7.Right-Of-WayAgent 1.Acquirenecessary project rights-of- way. 2.Ifnecessary, negotiate right-of-way costs with applicable property owners. Procurement of said services shallbe made in accordance with 24 CFR Part 85.34 (d) (3) and section 5G of the WestVirginia State Code. Contracts are to be awarded on a fixed fee basis with a ceilingon the amount available. Proposals must include: Experience of the firm with federal grant programs.Experience in providing professional services for this type of project.Qualifications of personnel directly involved in the project.Completeness of Proposal.Costs (proposed hourly fee with a not-to-exceed limit) All interested parties must submitfive (5) copies of their proposals detailing qualifications, technicalexpertise; management and staffing capabilities; and proposed hourly fee with anot-to-exceed limit. The selected firm will be requiredto comply with 2 CFR 200-Uniform Administrative Requirements, Cost Principles,and Audit Requirements for Federal Awards; Title VI of the Civil Rights Act of1964; Executive Order 11246; Section 109 of the Housing and Urban DevelopmentAct of 1974, Section 3 of the Housing and Urban Development Act of 1968, Conflictof Interest Statement and Access to Records provisions and all otherrequirements as they relate to potential funding sources..
