NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS April 19th 2023 Planning & Development Department City of Huntington 800 5th Avenue Huntington, WV 25701 304-696-5540 These notices shall satisfy twoseparate but related procedural requirements for activities to be undertaken bythe Cabell-Huntington-Wayne Housing Consortium. REQUEST FOR RELEASE OF FUNDS On or about May 5th2023, the city of Huntington will submit a request to the U.S. Department of Housingand Urban Development for the release of Cabell-Huntington-Wayne HousingConsortium HOIME funds under Title I of the Housing and Community DevelopmentAct of 1974 (PL 93-383), as amended, to undertake the following project: The proposed Imperial Lofts (the ”Project”) will involvethe acquisition of an approximate 1.10-acre parcel and the new construction oftwo (2) buildings containing a total of thirty-six (36) units serving familiesand seniors. The Project site is located at 2133 8th Avenue, Huntington, CabellCounty, WV, in Census Tract 0016.00. The Project’s census tract is largelydeveloped and is predominately filled with single-family houses. The Project issituated on an infill lot within an established neighborhood and has ample,usable greenspace. Project amenities andsupport services have been specifically designed for the advancement of thetenants. Units will feature Energy Star appliances, HVAC systems, exteriordoors and windows, and washers and dryers. The Project will also include acommunity fitness center, community room with kitchenette, resident storagelockers, indoor bike storage, and high-speed internet access. FINDING OF NO SIGNIFICANT IMPACT The city of Huntington hasdetermined that the project will have no significant impact on the humanenvironment. Therefore, an EnvironmentalImpact Statement under the National Environmental Policy Act of 1969 (NEPA) isnot required. Additional projectinformation is contained in the Environmental Review Record (ERR) on file atthe Planning & Development Department, City of Huntington, 800 5thAvenue, Huntington, WV 25701 and may be examined or copied weekdays 8 a.m. to4:30 p.m. PUBLIC COMMENTS Any individual, group, or agencymay submit written comments on the ERR to the City of Huntington’s Planning& Development Department. Allcomments received by May 4th 2023 will be considered by the City ofHuntington prior to authorizing submission of a request for release offunds. Comments should specific whichNotice they are addressing. ENVIRONMENTAL CERTIFICATION The City of Huntington certifiesto U.S. Department of Housing and Urban Development that Steve Williams, in hiscapacity as the Mayor, consents to accept the jurisdiction of the FederalCourts if an action is brought to enforce responsibilities in relation to theenvironmental review process and that these responsibilities have beensatisfied. U.S. Department of Housingand Urban Development approval of the certification satisfies itsresponsibilities under NEPA and relatedlaws and authorities and allows the City of Huntington touse HUD program funds OBJECTIONS TO RELEASE OF FUNDS U.S. Department of Housing and Urban Development will accept objections to its release of fundand the City of Huntington’s certification for a period of fifteen daysfollowing the anticipated submission date or its actual receipt of the request(whichever is later) only if they are on one of the following bases: (a) thecertification was not executed by the Certifying Officer of the City of Huntington; (b) the City of Huntington hasomitted a step or failed to make a decision or finding required by HUDregulations at 24 CFR part 58; (c) the grant recipient or other participants inthe development process have committed funds, incurred costs or undertakenactivities not authorized by 24 CFR Part 58 before approval of a release offunds by U.S. Department ofHousing and Urban Development;or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitteda written finding that the project is unsatisfactory from the standpoint ofenvironmental quality.
