NOTICE OF TRUSTEE SALE OF VALUABLE REALESTATE Pursuant to the authority vested in the undersigned by deed of trustdated the 19th day of December, 2005, signed by Charley E. Bennett, anunmarried man, to David G. Underwood, Trustee, which said deed of trust is ofrecord in the Office of the Clerk of the County Commission of Cabell County,West Virginia, in Trust Deed Book 2056, at page 624, said deed of trust havingbeen re-recorded in Trust Deed Book 2569 at page 375, and Golden & Amos,PLLC, Trustee having been requested so to do by the Secured Creditor, anddefault having been made under the terms and conditions of said deed of trust,and the provisions in said deed of trust concerning acceleration having beencomplied with by the Secured Creditor and present holder of the note, saidTrustee will sell at public auction at 9:00o’clock a.m. on the 16THDAY OF MAY 2023 atthe front doors of the Courthouse in Cabell County in Huntington, West Virginia thefollowing described real estate: Situatedin the State of West Virginia, County of Cabell and in the District ofGuyandotte. Allthose certain lots, pieces or parcels of ground situate in Guyandotte District,Cabell County, West Virginia, known and designated on a map of Altizer Place,marked Plat No. 2, made by Renshaw and Breece, Civil Engineers, filed in theOffice of the Clerk of the County Commission of Cabell County, West Virginia,July 6, 1915, as PART OF BLOCKS NUMBERS TWENTY-FOUR (24) and TWENTY-FIVE (25),of said subdivision, and known and designated on a map showing property of IraJ. Harshbarger, Trustee, Plat No. 2, March 1927, filed in said Clerk’s Officein Map Book No. 3, Map No. 109, as LOTS NUMBERS ONE (1) AND TWO (2). Itis the intention of this notice to sell the secured property by properdescription as was intended to be transferred and conveyed in the aforesaiddeed of trust. The above described real estate is reported to have amailing address of: 5001 Altizer Avenue, Huntington, WV 25705 TERMS OF SALE: Cash in hand onday of sale or within 30 days of date of sale upon terms to be agreed uponbetween Trustee and successful bidder, time being of the essence; payment forunpaid real estate taxes to be assumed by the purchaser. The Trustee does notwarrant title or fitness to this property; it is being purchased as is; this isa buyer beware sale and any buyer is advised to retain counsel before the sale.If there is any part of the process of sale which is found to be objectionable,the Trustee reserves the right to cancel the sale. No purchaser should takepossession or make improvements in the premises until the Trustee deed isdelivered or recorded. A third party purchaser at sale will be required to paythe purchase price plus all recording and transfer fees. Trustee at sale is under no dutyto cause any existing tenant or person occupying the subject property to vacatesaid property. FEDERAL TAX LIEN: In the eventthat there are Federal Tax Liens against the property, the United States wouldhave the right to redeem the property within a period of 120 days from the dateof such sale or the period allowable for redemption under local law, whicheveris longer. The party(ies) secured by theDeed of Trust reserve the right to purchase the property at such sale. If thepurchaser at sale is unable to complete the terms of purchase within 30 days,the Trustee reserves the right to transfer the property to the next highestbidder. Anysale hereunder may be adjourned from time to time without any notice other thanoral proclamation at the time and place appointed for this sale or by postingof a notice of same.
