ORDER OF PUBLICATION The object of the above entitled action is to seek Court approval of the proposed termination of the Robert David Kennedy Trust (the “RDK Trust”) and for a determination of questions of construction arising under the RDK Trust and a declaration of Trustee’s rights and legal relations in connection with the administration of the RDK Trust, specifically, to whom Trustee should distribute the RDK Trust assets – (a) the then living heirs of Geraldine S. Kennedy determined at the time of her death or (b) the then living heirs of Geraldine S. Kennedy determined at the time of termination of the RDK Trust, as more particularly set forth in the Complaint and Petition for Declaratory Judgment in this proceeding. And it appearing by affidavit filed in this action that the attorney for Plaintiff has been unable to locate Defendants, Edgar Lohr, Gayle Hill, unknown heirs of Patricia Donoho, unknown heirs of Terry Eugene Skaggs, unknown heirs of Gerald Leroy Skaggs, unknown heirs of Belinda Call, unknown heirs of Ramon Edward Skaggs, unknown heirs of Elrath Gene Skaggs, unknown heirs of Tracey Eugene Thompson, unknown heirs of Eleanor L. Skaggs Purdue, and unknown heirs of Mary Lou Skaggs Racheter. It is Ordered that Edgar Lohr, Gayle Hill, unknown heirs of Patricia Donoho, unknown heirs of Terry Eugene Skaggs, unknown heirs of Gerald Leroy Skaggs, unknown heirs of Belinda Call, unknown heirs of Ramon Edward Skaggs, unknown heirs of Elrath Gene Skaggs, unknown heirs of Tracey Eugene Thompson, unknown heirs of Eleanor L. Skaggs Purdue, and unknown heirs of Mary Lou Skaggs Racheter do appear and serve upon Joseph A. Ford, Dennis J. McGlaughlin, II and Robert J. Dobkin, Petitioner’s attorneys, whose address is 300 Kanawha Boulevard East, Charleston, WV 25301, an answer or other defense to the Petition for Declaratory Judgment filed in this action on or before 30 days from the date of first publication. Otherwise, judgment by default will be taken against said Defendants at any time thereafter.
