PUBLIC NOTICE Notice is hereby given that the Town of Poca, with the assistance of the B-C-K-P Regional Intergovernmental Council (RIC), has made available for public comment and review the Town of Poca’s Americans with Disabilities Act (ADA) Transition Plan. This plan has been developed based on the results of solicited public feedback, open comments submitted by the community and its leaders, and the results of the Town of Poca’s self-evaluation. The ADA is a civil rights law prohibiting the discrimination against individuals based on disability. It was enacted on July 26, 1990 and was amended in 2008 with the ADA Amendments Act. Title II of the ADA pertains to the programs, activities, and services provided by public entities. As a public entity, the Town of Poca must comply with this section of the ADA. (42 USC Sec. 12132; 28 CFR Sec. 35.130) No qualified individual with a disability shall, based on disability, be excluded from participation in or be denied the benefits of the services, programs, or activities of the Town of Poca, or be subjected to discrimination by the Town of Poca. (28 CFR Sec. 35.130) The Town of Poca shall make available to applicants, participants, beneficiaries, and other interested persons information regarding applicable code to the Town of Poca’s programs, services, or activities via this notice, its publicly available ADA Transition Plan, and an informational notice available at Town Hall. (28 CFR Sec. 35.106) The Town of Poca has conducted a self-evaluation of its buildings, communications, information, signage, public-rights-of-way, programs, services, policies, and practices and will proceed to make the necessary improvements. The Town of Poca shall deliver prompt and equitable resolution of complaints alleging any act of commission or omission that would be prohibited by the ADA and its applicable code. (28 CFR Sec. 35.107 (b)) Any interested or affected members of the public may submit comments regarding the proposed ADA Transition Plan, this public notice, or any entailed projects, priorities, or procedures to the Town of Poca by the ADA Coordinator prior to the planned adoption of the ADA Transition Plan on June 12th, 2023 at the regular town council meeting.
