TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated June 7, 2019, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 4367, at page 337, Woodrow B. McFann, III did convey unto Chris Eller, Trustee, certain real property described in said Deed of Trust; said Deed of Trust was modified in Deed of Trust Book 4556, at Page 842; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on February 29, 2024, at 5:59 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Jefferson District, Kanawha County, West Virginia, and more particularly described as follows: That certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate and being in Jefferson District, Kanawha County, West Virginia, being known as Lot No. 1 of Section 1 of Oak Tree Acres, as the same is shown upon and described upon a certain map entitled, “First Section Subdivision Map of Oak Tree Acres Developed By: Harry Mallory Near the City of South Charleston, Situated on the Waters of Shanty Branch of Mud Suck Fork, Jefferson District, Kanawha County, W. Va.,” dated October 16, 1986, revised January 21, 1991, prepared by Wilkinson Surveying and Engineering, Incorporated, a copy of which map was recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Photostatic Map Book 45, at Page 92. Along with an easement for ingress and egress over the existing roadway which leads to the lot herein conveyed to West Virginia Route 16, which easement shall be enjoyed in common with others who have the right to use such easement for ingress and egress purposes. Subject to those certain covenants and restrictions as contained in that certain agreement entitled “Declaration of Protective Covenants and Reservations Pertaining to Lots in Oak Tree Acres – Section I in Jefferson District, Kanawha County, West Virginia,” dated July 1, 1988, and of record in the aforesaid Clerk’s Office in Deed Book 2206, Page 545. Subject to the reservation of minerals and associated mining rights as contained in the Deed from Harry I. Mallory to Oak Tree Acres, Inc., dated May 27, 1988, recorded in said Clerk’s Office in Deed book 2204, Page 596. Map No.: 17F Parcel No.: 1 At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 301 Oak Tree Lane, South Charleston, WV 25309-9600. AND BEING the same real estate which was conveyed to Woodrow B. McFann, III, by Deed dated June 5, 2019, from Joy B. Mega, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 3039, at Page 418. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
