TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated July 22, 2022, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed of Trust Book 2896, at Page 310, Kevin B. Turley did convey unto David G. Palmer, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Cabell County Courthouse, in Huntington, West Virginia, on April 16, 2024, at 1:21 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the McComas District, Cabell County, West Virginia, and more particularly described as follows: All that certain lot, piece or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate approximately one-half (ONE-HALF) mile south of Salt Rock, West Virginia, near West Virginia State Route No. 10, on the waters of Tyler Creek, a tributary of the Guyandotte River in McComas District, Cabell County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a 2″ dia. steel rod (set) which bears N. 44DEGREES 25′ 56″ E., 25 feet from Power Pole No. 1714-114, and also N. 0DEGREES 40′ 29.5″ E., 316.44 feet from a 1-121/4″ dia. iron pipe (found) at the northwest corner of Parcel No. 2 now owned by Chelcie L. Gibson (Deed Book 739, Page 528); thence N. 28DEGREES 25′ 04″ W., 150.00 feet to a No. 5 rebar (set); thence N. 61DEGREES 05′ 56.0″ E., 100.00 feet to a No. 5 rebar (set); thence S. 28DEGREES 54′ 04″ E., 150.00 feet to a 2″ dia. steel rod (set); thence S. 61DEGREES 05′ 56″ W. 100.00 feet to the BEGINNING, containing 15,000 square feet, or 0.344 acre, more or less. There is further GRANTED AND CONVEYED an easement for the maintenance of a sewer system more particularly described as follows: A 10-foot wide easement for use of Sarbelio J. Monge and Carol L. Monge and Carol L. Bourdelais, husband and wife, (DB 974 Page 276), thence N. 51DEGREES 04′ 32″ E, 88.44 feet to a point in a small drain, thence with said drain, S. 78DEGREES 50′ E., 1304 feet to a point the said drain, thence leaving said drain, S. 51DEGREES 04′ 32″ W., 98.58 feet to a point in the easterly line of said Monge & Bourdelais, thence with said line, N. 28DEGREES 49′ 14″ W., 10.16 feet to the place of Beginning. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 119 Church Hill Lane, Salt Rock, WV 25559. AND BEING the same real estate which was conveyed to Kevin B. Turley by Deed dated July 15, 2022, from Patrick D. Nee, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 1468 at Page 515. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
