TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Trustees, by virtue of the authority vested in it by that certain Deed of Trust dated May 17, 2001, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed of Trust Book 1676, at Page 325, Terry D. Ellis did convey unto Richard A. Pill and Lew G. Tyree, Trustees, either of whom may act individually, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustees having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Cabell County Courthouse, in Huntington, West Virginia, on April 16, 2024, at 1:22 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Kyle District, Cabell County, West Virginia, and more particularly described as follows: All that certain lot, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of WOODSIDE PLACE, a copy of which map was recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia on November 28, 1913, in Deed Book 130 at Page 269, as LOT NO. 29, BLOCK NO. 8, and being more particularly described as follows: BEGINNING at a point in the north line of Tenth Avenue West at the corner between Lots 29 and 30, as shown on said map, which point is easterly 180 feet from the point of intersection of the said line of Tenth Avenue West with the east line of Sixth Street West; thence with the said line of Tenth Avenue West, easterly 30 feet to the corner between Lots 28 and 29; thence with the line between said lots, northerly 100 feet to a point in the south line of a 10 foot alley; thence with said alley line, westerly 30 feet to the northerly corner between said Lots 29 and 30; thence with the line between said lots southerly 100 feet to the point of BEGINNING. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 538 W. 10th Avenue, Huntington, WV 25701. AND BEING the same real estate which was conveyed to Terry D. Ellis, by Deed dated May 17, 2001, from Donald L. Weaver and Donald L. Weaver, II, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 1079, at Page 343. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Trustees shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
