TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 21, 2017, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 4261, at Page 439, Patrick Fields and Amanda Shanklin did convey unto Douglas McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Rocket Mortgage, LLC f Quicken Loans, LLC f Quicken Loans Inc. to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on April 23, 2024 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 15 – Elk District, Kanawha County, West Virginia, and more particularly described as follows: Land situated in the County of Kanawha in the State of WV All that certain piece or parcel of land situate in Elk District, Kanawha County, West Virginia, being the surface only of a part of Lot No. Two (2) of the Whiston Hughes Estate on the Waters of Indian Creek and being more particularly bounded and described as follows: Beginning at an iron pin in the northerly side of the Bream-Pinch Road (Secondar No. 49) in the center of a joint 16-foot wide right of way which serves the parcel hereby conveyed and the parcel adjacent on the northwesterly side thereof; thence N. 23 14′ E. 40 feet to an iron pin in the center of said right of way; thence N. 36 38′ E. 105 feet to an iron pin in the center of said right of way at the entrance to a joint parking area; thence S. 55 05′ E. 40.3 feet to an iron pin; thence N. 33 32′ E. 65 feet to an iron pin; thence S. 56 28′ E. 104.0 feet to an iron pin; thence S. 28 51′ W. 188.8 feet to an iron pin the northerly side of said Bream-Pinch Road; thence with the northerly line of said road, N. 63 41′ W. 159.5 feet to the point of beginning, all as shown upon a map which is attached to and a part of a Deed made to Robert L. Douglas and wife, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1610, at page 244 (said map being at page 247). Together with the benefits and burdens of the rights of way and easements incorporated by reference in Deed of March 1, 1972, of record in said Clerk’s Office in Deed Book 1650, at page 423. Commonly known as: 4061 Indian Creek Rd, Elkview, WV 25071-9402 At the time of the execution of the Deed of Trust, this property was reported to have an address of: 4061 Indian Creek Rd, Elkview, WV 25071. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
