NOTICE OF SUCCESSOR TRUSTEE’S SALE NOTICE IS HEREBY GIVEN by virtue of the authority vested in the undersigned Successor Trustee, Jonathan Nicol, by that certain Substitution of Trustee Agreement, dated March 8, 2024, executed by Toorak Capital Partners, LLC, successor in interest to RCN Capital, LLC, who was the original beneficiary named in the deed of trust described below, recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 4684 at page 665, being the same authority which was originally vested in Amy J. Haynie, as Trustee, in that certain Deed of Trust, Assignment of Rents, Security Agreement and Fixture Filing made by ROYAL INVESTMENT GROUP, LLC, a West Virginia limited liability company, dated June 15, 2021, recorded in said Clerk’s Office in Trust Deed Book 4516 at page 196, the maker of the instrument secured by said deed of trust is in default, and Toorak Capital Partners, LLC, the current beneficial owner and holder of said instrument, has elected to treat the whole principal debt thereby secured as immediately due and payable. NOW, THEREFORE, the undersigned Successor Trustee, having been requested by the beneficial owner of said instrument to do so, will proceed to sell at public auction at the front door of the Courthouse of Kanawha County, Virginia Street side, in the City of Charleston, West Virginia, at 11:00 o’clock a.m. on Thursday, April 25, 2024, for cash to the highest bidder, all of the following described real property, together with the improvements thereon and appurtenances thereunto belonging, located in Kanawha County, West Virginia, and being more particularly bounded and described in said deed of trust as follows: The real property located in Kanawha County, West Virginia, at 1618 Odell Avenue, Charleston, WV 25302, as such real property is more particularly described as follows: All of those certain lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Charleston West District. Kanawha County, West Virginia and being more particularly described as follows: Situate in Charleston West District of Kanawha County, West Virginia, and being more particularly bounded and described as follows: BEING all of that portion of Lot H of Block No. Six (6) of the upper Glen Elk Bottom Lands, as shown upon the map thereof of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Map Book 2, page #A, which fronts and abuts upon the southerly line of O’Dell Avenue (formerly known as Willies Alley) and extends back therefrom towards Bigley Avenue between parallel side lines, being the side lines of said Lot H of Block No. Six (6), a distance of one hundred thirty (130) feet, more of sic less, on the upper or easterly side thereof and a distance of one hundred thirty one and one half (131 ONE-HALF) feet, more of sic less, on the lower or westerly side thereof, the said lot having a uniform width of fifty’ (50) feet measured at right angles to said side lines, which said lot hereby conveyed also abuts upon and joins the northerly line of that certain lot or parcel of land conveyed unto Glen Blackwell and Ruth Blackwell, his wife, by Laura Marks and others by deed bearing date the 28th day of March, 1945, of record in the aforesaid Clerk’s Office in Deed Book 696, page 393. SAVING AND EXCEPTING an out conveyance the the sic West Virginia Department of Highways of 1,950 square feet as recorded in Deed Book 1600, Page 117. And being Parcel Two of the same property conveyed unto Jeff Honaker, Jr. by deed dated October 31,2018 from Donna Jean Richardson of record in the aforesaid Clerk’s office in Deed Book 3015, at page 638. The undersigned Successor Trustee reserves the right to adjourn this sale from time to time as the interests of the parties may require, and without any notice other than by oral proclamation at the time and place appointed for sale. This sale shall be made subject to any prior lien, liens entitled to priority over the lien created by the subject deed of trust, restrictions, conditions, reservations and easements contained in deeds or instruments of record in said Clerk’s Office, and subject further to all unpaid real estate taxes and special assessments, if any, the purchaser assuming the payment thereof. The undersigned Successor Trustee further reserves the right to accept or reject any and all bids in his sole and absolute discretion. The undersigned Successor Trustee will deliver to the purchaser a deed conveying the subject property without any covenant or warranty, express or implied. Before the purchaser’s bid is accepted and before the bidding is closed, the purchaser will be required to execute a Memorandum of Sale. The purchaser shall be responsible for the payment of any transfer taxes and recording fees necessary to place of record the aforesaid deed. In the event the subject property is occupied, the undersigned Successor Trustee shall be under no duty to cause any existing tenant or occupant to vacate the subject property.
