NOTICE OF PUBLIC HEARING VILLAGE OF BARBOURSVILLE, WEST VIRGINIA NOTICE OF PUBLIC HEARING OF AN ORDINANCE AUTHORIZING THE VILLAGE OF BARBOURSVILLE TO RESTRICT VEHICLE ACCESS TO PORTIONS OF A PUBLIC ALLEY LOCATED AT THE CORNER OF THE BRADY STREET AT ITS INTERSECTION WITH THE WEST RIGHT OF WAY OF CENTRAL AVENUE, AND TO LEASE TO BUSINESSES AS LESSEES THE ALLEY TO BE USED AS AN OUTDOOR DINING AREA AND FOR OTHER PURPOSES RELATED THERETO. AUTHORITY UNDER W.Va. Code W. Va. Code 8-11-3, 8-12-1, 8-12-5, and 8-12-18 of the Code of West Virginia, 1931, as amended – Notice is hereby given by the Village of Barboursville, West Virginia, that it will hold a public hearing on Tuesday, April 16, 2024, at 7:15 pm at City Hall, Council Chambers, 721 Central Avenue, Barboursville, West Virginia 25504. The purpose of this public hearing is to discuss the Village of Barboursville’s proposed Ordinance, the principal object of which is to restrict the public alley located at the corner of the Brady Street at its intersection with the west right of way of Central Avenue to pedestrian traffic only, leasing of the Property to Lessees for outdoor dining under the terms and conditions of the Form Lease Agreement attached as an Exhibit to the Ordinance, and where said leased Property shall remain a public right of way, and the City shall have a right to access the Property for any legitimate governmental reason, including but not limited to performing utility maintenance, building inspections, streetlight maintenance, or sidewalk maintenance, and will benefit the inhabitants of the City; and such other terms as in the Ordinance, and at such hearing all objections and suggestions shall also be heard and the Village of Barboursville council shall then take such action as it shall deem proper upon an Ordinance titled: AN ORDINANCE AUTHORIZING THE VILLAGE OF BARBOURSVILLE TO RESTRICT VEHICLE ACCESS TO PORTIONS OF A PUBLIC ALLEY LOCATED AT CORNER OF THE BRADY STREET AT ITS INTERSECTION WITH THE WEST RIGHT OF WAY OF CENTRAL AVENUE, AND TO LEASE TO BUSINESSES AS LESSEES THE ALLEY TO BE USED AS AN OUTDOOR DINING AREA AND FOR OTHER PURPOSES RELATED THERETO. The information gathered and presented at this public hearing will be utilized by the Village in its discussion and determination on whether to adopt the Ordinance and approve the Form Lease Agreement. The Village of Barboursville proposed Ordinance will be available for public inspection in the City Hall, 721 Central Avenue, Barboursville, West Virginia 25504, during normal business hours, Monday through Friday (excluding holidays), between the hours of 8:00 am and 4:00 pm. A first reading of the Ordinance was held on Tuesday, April 2, 2024, in City Hall, 721 Central Avenue, Barboursville, West Virginia 25504. A public hearing will be held on Tuesday, April 16, 2024, at 7:15 pm, in City Hall, 721 Central Avenue, Barboursville, West Virginia 25504. A second reading and vote on the Ordinance will take place immediately after the public hearing at the regularly scheduled Council meeting at 7:30 pm on Tuesday, April 16, 2024.
