ORDER OF PUBLICATION The Plaintiff, The Poca Valley Bank (“Plaintiff’), pursuant to Rule 4 of the West Virginia Rules of Civil Procedure for Trial Courts of Record, has petitioned this Court for judgment against the Defendants, Jacob Lee Martin and Johnna M. Smith, jointly and severally, in a sum certain amount resulting from the Defendants’ breach of a contract dated June 4, 2021, wherein the Defendants entered into contract with the Plaintiff for the financing of the purchase of a certain 2021 MITSUBISHI OUTLANDER SPORT WAGON 4D BE AWC BLACK. It appearing that whereabouts of the Defendant, Jacob Lee Smith, is unknown to the Petitioner and cannot be determined by reasonable due diligence. It is, therefore, ORDERED and ADJUDGED, pursuant to Order of the Circuit Court of Kanawha County, West Virginia, that the Defendant, Jacob Lee Smith be served notice of the proceedings by Order of Publication, and that the Defendant, Jacob Lee Smith, do appear and serve any written response or answer to the Complaint on Plaintiff’s counsel, Harrison M. Cyrus, 500 Virginia Street East, Suite 600, Charleston, West Virginia 25301, within thirty (30) days of the date of publication otherwise the relief sought by Plaintiff may be granted by the Court at any time thereafter. It is further ORDERED, pursuant to Court Order, ORDERED that this Order of Publication shall be published in shall be published in the Charleston Newspapers once a week for two successive weeks, as required by law, and said newspaper return a Certificate of Publication upon completion of such.
