NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of authority vested in the undersigned Trustee by that certain deed of trust executed by KATELAND O. HEATH to KERRY E. ADKINS and MICHAEL D. STEPHENS, JR., Trustee dated May 30, 2023, securing HUNTINGTON FEDERAL SAVINGS BANK, and recorded in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book No. 2924, at page 738, by which was conveyed to the said Trustee the hereinafter described real estate, to secure the payment of a ce1tain note set out and described therein, and the owner and holders of said note, in exercise of the right and authority granted in the aforementioned deed of trust, having appointed FLYNN, MAX, MILLER & MILLER, L.C. as Substitute Trustee, by that certain Appointment of Substitute Trustee dated February 27, 2025, and recorded in the aforesaid Clerk’s Office in Bonds, Contracts and Leases Book 422, at page 714, and default having been made in the payment of said note, and the said FLYNN, MAX, MILLER & MILLER, L.C., Substitute Trustee having been requested so to do by the owner and holder of said note, shall sell to the highest and best bidder, on Wednesday, the 30th day of April, 2025, at 10:00 a.m., at the East Front Door of the Cabell County Courthouse, Huntington, WV, the following described real estate: PARCEL 1: All that certain lot, piece or parcel of land situated in the City of Huntington, Cabell County, West Virginia, known and designated on a map of Plat 4, Holswade Park, a copy of which map was filed in the Cabell County Court Clerk’s office on July 30 1940, in Map Book 4, as Map 49, as LOT NO. Two Hundred Nine (209) and a 7.5 foot wide parcel of land adjoining on the north, being the southerly half of the alley as BEGINNING at a point in the north line of Cherry Avenue at the corner between Lots 209 and 210 as shown on said map; thence with the said line of Cherry Avenue easterly 38.94 feet; thence continuing with the said line of Cherry Avenue, curving to the left in an easterly direction with a radius of 505 feet, a distance of 22.88 feet; thence leaving the said line of Cherry Avenue and with the line between Lots 208 and 209 and that line produced, northerly 124.61 feet to a point in the center line of what was formerly a 15-foot alley or driveway; thence with said center line westerly, curving to the right with a radius of 380.93 feet, a distance of 17.69 feet; thence continuing with said center line westerly 38.24 feet to a point in the line between said lots 209 and 210 produced to said center line; thence with the line between said lots southerly 124.57 feet to the point of BEGINNING; subject, however, to an easement over and across the northerly 2.5 feet of the described property, said 2.5 feet being the southerly half of a 5-foot easement for sewer and utility lines. PARCEL 2: All that certain lot, piece or parcel of land situated in the City of Huntington, Cabell County, West Virginia, known and designated on a map entitled “Plat 4, Holswade Park”, made by Breece & Carper, Engineers, and recorded in the Cabell County Court Clerk’s Office, West Virginia, in Map Book 4, as Map 49, as the westerly part of LOT NO. Two Hundred Eight (208) and being more particularly described as follows: BEGINNING at a point in the north line of Cherry Avenue, at the corner between Lots 208 and 209, as shown on said map; thence with the said line of Cherry Avenue, curving to the left in an easterly direction with a radius of 505 feet, a distance of 15 feet; thence leaving said avenue and through said Lot 208 N. 23 48′ W. 117.13 feet to a point in the south line of 15-foot alley; thence said alley line, curving to the right in a westerly direction with a radius of 388.43 feet, a distance of 11.41 feet to the northerly corner between said Lots 208 and 209; thence with the line between said lots S. 22 07′ E. 117.11 feet to the point of BEGINNING. TERMS OF SALE: Ten percent (10%) cash in hand on day of sale with the balance due within 30 days, subject to any and all unpaid taxes, and purchaser pays all transfer tax, the deed preparation and recording fee.
