BEFORE THE UNSAFE BUILDINGS COMMISSION OF THE CITY OF HUNTINGTON, CABELL AND WAYNE COUNTIES, WEST VIRGINIA IN RE: RUSHIA RATLIFF 8 FERRELL COURT, HUNTINGTON, WEST VIRGINIA 25704 PROPERTY: 8 FERRELL COURT (ALL STRUCTURES), HUNTINGTON, WV ORDER OF DEMOLITION On Thursday, the 10th day of April, 2025, the Unsafe Buildings Commission of the City of Huntington came on for hearing as provided by Article 1739 of the Codified Ordinances of the City of Huntington, as revised. After it first being determined that Notice was duly and properly given as provided by law, a majority of the Commission agreed that the structure located at 8 FERRELL COURT (ALL STRUCTURES), within the limits of the City of Huntington is unsafe, unsanitary, dangerous and/or detrimental to the public welfare and should be demolished. Therefore, it is hereby ORDERED that the structure located at 8 FERRELL COURT (ALL STRUCTURES), within the limits of the City of Huntington be DEMOLISHED within thirty (30) days after entry of this Order pursuant to the provisions of Article 1739 of the Codified Ordinances of the City of Huntington, as revised. If the structure is not demolished within 30 days, the City of Huntington shall DEMOLISH or otherwise remediate the structure at its convenience. It is further ORDERED that the structure located at 8 FERRELL COURT (ALL STRUCTURES) shall be SECURED and BOARDED within five (5) days after entry of this Order pursuant to the provisions of Article 1739 of the Codified Ordinances of the City of Huntington, as revised, until such time as the structure is demolished. If the structure is not SECURED and BOARDED within 5 days, the City of Huntington shall cause the structure to be secured and boarded reasonably soon thereafter. It is further ORDERED that the City of Huntington, its agents, employees, and contractors may enter 8 FERRELL COURT (ALL STRUCTURES) at any time after the expiration on 30 days after entry of this Order to perform any work or preparation for demolition including, but not limited to, salvage, asbestos inspection, asbestos removal, and the removal of items that may prove dangerous or obstructive in the demolition process. It is further ORDERED that the City of Huntington shall have the right to issue a citation for failure to comply with this Order. Violations of this Order may be fined $500.00 or imprisoned for a period of not more than 30 days, or both, and each day shall constitute a separate offense. It is further ORDERED that the property owner(s), RUSHIA RATLIFF, shall pay for all costs associated with the demolition of the structure located at 8 FERRELL COURT (ALL STRUCTURES), Huntington, West Virginia. It is further ORDERED that the City of Huntington shall have the right to file a lien against the real property located at 8 FERRELL COURT (ALL STRUCTURES), Huntington, West Virginia, or to institute civil action in a court of competent jurisdiction against the property owner or other responsible party for all costs incurred with respect to said demolition and for reasonable attorney’s fees and court costs incurred by the City of Huntington in the prosecution of said collection of said costs relating to the demolition of the structure. Said lien, unless otherwise stated, shall accrue interest at the statutory rate. It is further ORDERED that this Order of Demolition shall be served in accordance with the laws of this state concerning service of process of civil actions, and shall, in addition thereto, be posted in a conspicuous place on the premises affected by the Order of Demolition. If you disagree with this Order, you have the right to apply to the circuit court of the county for a TEMPORARY INJUNCTION restraining the Unsafe Buildings Commission pending final disposition of the cause before the circuit court.
