NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated December 16, 2016, executed by Borrower, Rhonda L Kersey, to Douglas McElwee, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2644, at Page 548. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 47 Lucky Day Lane, Ona, WV 25545. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 14, 2025, of record in the Clerk’s Office in Book 424, Page 8. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: 24th day of July, 2025 at 11:00 a.m. A lot of land situate on the waters of Big Cabell Creek, about two miles east of Howell Mill Road, Union District, Cabell County, West Virginia, more particularly described as follows: Lot 1, Beginning on a I.P. at Rock Camp on Big Cabell Creek, thence N. 79 45` E. 170.00 feet with old fence property line to I.P. on Hill; thence S. 8 20` W. 670.33 feet to a 6 inch pine at a toe of hill, thence S. 33 04` E. 205.05 feet to stone at toe of hill; thence S. 16 W. 97.4 feet passing 5 feet east of water well house to I.P. on north side of a 30-foot public road; thence N. 82 45` W. 77.65 feet with north side of right of way to I.P.; thence S. 82 26` W. 206.04 feet with north side of right of way to fence post corner to David Scarberry; thence N. 9 E. 250 feet with Scarberry east line to fence post corner; thence N. 80 45` W. 92.0 feet with Scarberry north line to post corner on east edge of Big Cabell Creek; thence N. 3 30` E. 140.0 feet with Big Cabell Creek; thence N. 4 30` E. 153.0 feet with Big Cabell Creek to a 24-inch sycamore; thence N. 23 30` E. 394.5 feet with Big Cabell Creek to the BEGINNING, containing 5 acres more or less. And being the same property conveyed unto Roger A. Clagg and Sara E. Clagg, from Roy S. Yates, by Deed dated June 30, 1998 of record in the aforementioned Clerk`s Office in Deed Book 1034, at page 547. Excepting and Reserving a new tract of land located east of West Virginia County Route 1/11 along Big Cabell Creek, being located in the union Magisterial District of Cabell County, West Virginia. This tract of land being +/- 1.331 acres of the parent tract of land and being the same tract of land conveyed unto Travis R. Clagg and Crystal G. Clagg, from Roger A. Clagg and Sara E. Clagg, by Deed dated December 22, 2004, of record in the aforementioned Clerk`s Office in Deed Book 1134, at page 66. Also, Excepting and Reserving a new tract of land located east of West Virginia County Route 1/11 along Big Cabell Creek being located in the Union Magisterial District of Cabell County, West Virginia. This tract of land being +/- 0.931 acres and being the same tract of land conveyed unto Alison E. Clagg, from Roger A. Clagg and Sara E. Clagg, by Deed dated December 22, 2004, of record in the aforementioned Clerk`s Office in Deed Book 1134, at page 69. Subject to an easement for ingress and egress over the property herein conveyed from Route 1/11 to the out sale parcels described herein. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
