NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson and L. Elizabeth King, by that certain Deed of Trust made by Deborah L. Burford and Timothy C. Burford, dated August 5, 2015, and recorded August 7, 2015, in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 4117, at page 738, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated March 17, 2025, and recorded April 1, 2025, in the aforesaid Clerk’s office in Trust Deed Book 4738, at page 884, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on Thursday, July 17, 2025 at 11:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate the City of Nitro District, Kanawha County, West Virginia, being more particularly bounded and described as follows: All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Nitro District, Kanawha County, West Virginia, and being more particularly bounded and described as follows: All of Lot No. 52, 21st Street, together with the buildings and improvements thereon comprising a part of Area “R”, shown on the Property Map of the U. The said property herein conveyed is a part of Area “R”, shown upon a map entitled, “Plats of Areas P. R. And S of the Nitro Reservations”, recorded and filed in the aforesaid Clerk’s Office in Map Book 2, at page 130, on November 16, 1921, said Area “R” being a part of the lands conveyed by the United States Government to the Charleston Industrial Corporation by Deed dated September 16, 1922, and recorded and files in the aforesaid Clerk’s Office in Dee Book 244, at page 474, on October 12, 1922, together with a map of said property entitled. “Property Map of United States Explosive Plat “C”, Nitro, West Virginia, and filed in said Clerk’s Office in Map Book 2, 124 on September 1, 1921. AND BEING THE SAME property conveyed unto Deborah L. Burford and Timothy C. Burford, by Connie L. Lucas by Deed dated the 5’h day of August, 2015. At the time of execution of the deed of trust, the grantor represented that the address of the property was 2152 21st Street, Nitro, WV 25143. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold to the highest bidder, who shall be obligated to pay an initial deposit to the Trustees at the time of sale in the amount of 10% of the bid amount, and the remaining balance shall be paid to the Trustees on or within 20 days of the date of the auction. In addition to the payment of the bid, the purchaser of the property at the sale shall be responsible for paying a 10% buyer’s premium to Joe R. Pyle Complete Auction & Realty LLC immediately at the conclusion of the auction. This buyer’s premium is in addition to the winning bid amount. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and WesBanco Bank, Inc., shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
