TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 19, 2001, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 2757, at Page 583 and modified in Book No.4256, at Page 718 and modified in Book No. 3351, at Page 996 and modified in Book No. 3562, at Page 370 and modified in Book No. 4031, at Page 981, Joseph M Casto and Amber N Casto did convey unto Susan L. Petrella and Nicholas W. Johnson, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MidFirst Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on April 7, 2020 at 4:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Union District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Union District, Kanawha County, West Virginia, near Cross Lanes and being all of Partition “C”, as the same is shown and designated upon a map entitled, “SURVEY OF Resubdiviions of Tax Parcels 25 and 26, being a resubdivision of Lot 46 in Mathews Baby Farms Flatwoods in Partitions A, B, and C SITUATED IN Union District, Kanawha County, West Virginia SURVEYED FOR Maxine V. Casto, Kenton B. and Yvette C. Wood (exclusively)”, made by edward Ben Converse, L.L.S., and dated February 10, 1978, a copy of which map is attached hereto, incorporated herein and filed herewith; said parcel herein conveyed being more particularly bounded and described as follows: BEGINNING at an iron pin in the westerly line of the 30 foot road which runs from Valley Road to Ridge Road (the center line of said road being the common division line between Lots 37 and 46 of Matthews Baby Farms Addition) and which said iron pin is N. 1 50′ E. 699.97 feet from a monument at the intersection of the westerly line of said 30 foot road with the northerly line of said Valley Road; thence running through said Lot No. 46 of said Matthews Baby Farms, N. 89 26′ W. 116.55 feet to an iron pin and the westerly line of said 30 foot road; thence with the westerly line of said 30 foot road, S 1 50′ W. 75 feet to the place of beginning; And BEING the same property conveyed unto Joseph M. Casto and Amber N. Casto, husband and wife, by Kenton B. Wood and Yvette C. Wood, husband and wife by Deed dated October 19th, 2001, and to be recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia simultaneously herewith as part of this transaction. There is reserved and excepted from this conveyance a perpetual right of way and easement five feet in width extending along the entire length and lying adjacent thereto and contiguous therewith the southerly line of the property herein conveyed for the purpose of installing, laying, maintaining, operating, removing and repairing utility lines, including gas, water, electric and sewer lines and which said easement is reserved for the purpose of servicing the property owned by the parties of the first part which lies to the rear of the property herein conveyed, and for the benefit of the parties of the first part, their heirs, assigns, and successors in title. This conveyance is made expressly subject to the mineral reservation and the rights of way related thereto as are set forth and mentioned in that certain deed to James P. Randolph and Janie O. Randolph, his wife, from Daniel Matthews, etals, dated February 9, 1943, of record in the said Clerk’s Office in Deed Book 649 at page 257. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 5154J Dover Drive, Cross Lanes, WV 25313. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
