NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of the authority vested in the undersigned Trustee by that certain Deed of Trust executed by Clinton Stewart, to Mitchell Lee Klein, Trustee, dated September 6, 2001, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 1699, at Page 490, by which was conveyed to the said Trustee, the real estate hereinafter described, to secure the payment of a certain security instrument (“note”) set out and described and referenced therein; and furthermore, Paul A Ryker, having been designated as Substitute Trustee by the document titled as “Substitution of Trustee”, recorded in the office of the said Clerk in Bonds, Contracts and Leases Book 404, at Page 463, default having been made in the payment of said note, and the said Paul A Ryker, Trustee, having been requested to do so by the owner and holder of said note, and having full and absolute power and authority in the premises, the said Paul A Ryker, Trustee, shall sell to the highest bidder, on Thursday, the 24th day of September, 2020, at 11:00 a.m., at the east door of the Cabell County Courthouse, in Huntington, West Virginia, the following described real estate: All that certain piece or parcel of land situate in Barboursville District, Cabell County, West Virginia, bounded and described as follows: BEGINNING at an iron pin found in the east right of way line of Pea Ridge Road, said point being the southwest corner to Lot 101 of Stonewood Townhouses, as recorded in the Cabell County, West Virginia Clerk’s Office in Deed Book 917, at Page 626, and being the northwest corner to Brady, Deed Book 1036, at Page 147; thence leaving said Pea Ridge Road with the north line of said Brady, S. 72 09′ E. 183.75 feet to a steel bar set; thence crossing said Brady, S. 13 15′ W. 126.24 feet to a steel bar set in the south line of Brady; thence with said south line of Brady, N. 73 20′ W. 183.49′ to a steel bar set in the east line of said Pea Ridge Road; thence with said eastline of Pea Ridge Road,N.13 15′ E. 130.04′ to the PLACE OF BEGINNING. Containing 0.54 acre, more or less, as shown on a plat entitled “Plat Of Surveying For Parcel For: Linda Brady”, dated August 15, 2001, as prepared by Danny Jones Surveying, Inc., as appearing of record. TERMS OF SALE: 1. Cash in hand paid on the day of sale. 2. The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-way, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 3. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-2-1. 4. The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 5. The Trustee and/or Substitute Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee . 6. The Trustee and/or Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
